FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

   The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

   Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decision law.

   For individuals who wish to challenge an action, appeals must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

   20.  To replace and maintain a 8-inch diameter natural gas line temporarily impacting a 0.01 acre of PEM wetland of a UNT to West Branch Sideling Hill Creek (EV) (Mench, PA Quadrangle N:  3.23 inches; W:  14.54 inches, Latitude:  39° 53` 34.09"; Longitude:  78° 21` 11.81").

   All activities are related to the improvements of an existing natural gas storage wells in Monroe Township, Bedford County.

   E14-506. Krislund Camp and Conference Center, P. O. Box 116, Madisonburg, PA 16852. Krislund Camp and Conference Center, in Miles Township, Centre County, United States Army Corps of Engineers, Baltimore District (Madisonburg, PA Quadrangle N:  13.32 inches; W:  7.63 inches).

   To construct and maintain: 1) fill in an intermittent 75 foot long channel with a maximum width of 7 feet and a maximum depth of 0.5 feet of a UNT of Roaring Run; 2) a 6-inch diameter corrugated plastic pipe underdrain outlet; 3) an 8-foot by 8-foot by 2-foot deep bowl shaped R-3 riprap rock basin; 4) three in-channel rock filters evenly spaced in the channel within the first 100 feet downstream of the toe of the fill; and 5) Seven water line crossings and eight sewer line crossings of waterways with drainage areas less than 100 acres to make a 6.22 acre grass playfield located 1 mile southwest from the intersection of the Krislund Camp Drive and the SR 445. This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E41-586. Department of Conservation and Natural Resources, RCSOB, 8th Floor, 400 Market Street, Harrisburg, PA 17101-8451. Water Obstruction and Encroachment Joint Permit, in Cummings Township, Lycoming County, United States Army Corps of Engineers, Susquehanna River Basin District (Jersey Mills, PA Quadrangle N:  41° 19` 6.1"; W:  7° 23` 31.4").

   To construct and maintain a 60-foot by 13-foot Con-Span bridge on a skew of 70°, over Lower Pine Bottom Run, located off the intersection of SR 0044 and SR 0414. This project proposes to permanently impact 60 linear feet of Lower Pine Bottom Run, which is designated a HQ-CWF stream and does not propose to impact any jurisdictional wetlands. This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E60-190. Buffalo Creek Watershed Alliance, P. O. Box 501, Lewisburg, PA 17837. Water Obstruction and Encroachment Joint Permit Application, in Hartley Township, Union County, United States Army Corps of Engineers, Susquehanna River Basin District (Hartleton, PA Quadrangle N:  40° 56` 22"; W:  77° 13` 43").

   To construct and maintain an 8" PVC intake, a concrete weir measuring 25 feet long, 1.5 feet wide and 2.9 feet high and 70 linear feet of R-3 lined outfall swale measuring 8 feet wide and 1 foot deep into Buffalo Creek. This project proposes to have a minimal impact on Buffalo Creek, which is designated a HQ-CWF and does not propose to impact any jurisdictional wetlands. The project is located along Buffalo Flat Road approximately 5.0 miles northeast of intersection with SR 0045. This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   Southwest Region: Watershed Management Program Manager, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.

   E02-1571. Allegheny County Airport Authority, Landside Terminal, 4th Floor, Mezzanine Level, Pittsburgh, PA 15231-0370. To place fill in wetlands in the Borough of West Mifflin, Allegheny County, United States Army Corps of Engineers, Pittsburgh District. (Glassport, PA Quadrangle N:  18.2 inches; W:  8.8 inches, Latitude:  40° 20` 57"; Longitude:  79° 56` 14"). To place and maintain fill in a de minimis amount of palustrine, forested wetland (0.04 acre) and to construct and maintain an approximately 225 linear foot long stream enclosure consisting of a 30-inch diameter culvert in a UNT to Lewis Run (WWF), which has a contributory drainage area that is less than 100 acres, for the purpose of constructing the Century III KIA Car Dealership Development. With wingwalls and riprap outlet protection, the project will impact a total of 290-ft of watercourse. The project is located on the north side of Lebanon Church Road, just east from the intersection of Lebanon Church Road and Lebanon Road (SR 885).

ENVIRONMENTAL ASSESSMENTS

   Central Office: Bureau of Waterways Engineering, Rachel Carson State Office Building, Floor 3, 400 Market Street, Harrisburg, PA 17105.

   Project proposes to breach and remove nine low head dams in an approximately 2 mile section of Rolling Rock Creek (HQ-CWF) for the purpose of eliminating a threat to public safety and restoring the stream to a free flowing condition. The project will restore approximately 300 linear feet of stream channel. The dams are located approximately 4 miles south of the intersection of US 30 and SR 381 (Rector Road).

   D33-028EA. PGC--Northwest Regional Office, P. O. Box 31, Franklin, PA 16323. Polk Township, Jefferson County, United States Army Corps of Engineers, Pittsburgh District.

   Project proposes to breach and remove Manners Run Dam across Manners Dam Run (HQ-CWF) for the purpose of eliminating a threat to public safety and restoring the stream to a free flowing condition. The project will restore approximately 800 feet of stream channel. The dam is located approximately 2 miles east of the intersection of Richardson Road (SR 968) and Game School Road (SR 1010) (Munderf, PA Quadrangle Latitude:  41° 17` 50"; Longitude:  78° 53` 43").

DAM SAFETY

   Central Office: Bureau of Waterways Engineering, 400 Market Street, Floor 3, P. O. Box 8554, Harrisburg, PA 17105-8554.

   D56-103EA. Indian Lake Borough, 1301 Causeway Drive, Central City, PA 15926-7621. Project proposes to modify Indian Lake Dam to address existing structural inadequacies impacting approximately 0.08 acre of wetland (PEM) and 0.20 acre of open water. The modifications will include placing additional buttressing fill along the downstream face of the dam and constructing a toe drain system. The dam is located across Calendars Run (CWF) approximately 1,300 feet north of the intersection of South Shore Trail and Causeway Drive (Central City, PA Quadrangle Latitude:  40° 01` 42"; Longitude:  78° 52` 20"). The dam owner has met the wetland replacement requirement by participating in the Pennsylvania Wetland Replacement Project. Indian Lake Borough, Somerset County.

Public Hearing Notice

   The Department of Environmental Protection (Department), will conduct a public hearing to solicit comments on Environmental & Recycling Services, Inc. Landfill's Phase IV Expansion Application, I.D. No. 100932, located in Taylor Borough, Lackawanna County. The Public Hearing has been scheduled for Tuesday, July 15, 2008, from 6-8 p.m. at the Scranton State Office Building, 100 Lackawanna Avenue, Scranton, PA.

   A copy of the application may be viewed at the Department Northeast Regional Office, 2 Public Square, Wilkes-Barre, PA 18711-0790. For further information, contact William Tomayko at (570) 826-2511. Also, a copy of this application has been provided to Taylor Borough, the Lackawanna County Commissioners and the Lackawanna County Planning Commission.
