FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department of Environmental Protection (Department). Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the State to certify that the involved projects will not violate the applicable provisions of sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA or to the issuance of a Dam Permit, Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment must submit comments, suggestions or objections within 30 days of the date of this notice, as well as questions, to the regional office noted before the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Individuals will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on each working day at the regional office noted before the application.

 Persons with a disability who wish to attend a hearing and require an auxiliary aid, service or other accommodation to participate in the proceedings should contact the specified program. TDD users should contact the Department through the Pennsylvania AT&T Relay Service at (800) 654-5984.

 To remove an existing 42-foot wide, partially-submerged asphalt boat launch approach ramp to Lake Wallenpaupack (HQ-CWF), and to construct and maintain five (5) sections of 42-foot wide x 90-foot long x 8-inch high reinforced concrete slab ramping placed on a crushed stone base and lined with R-4 rip-rap.

 Also, to remove an existing 30 square foot wooden floating dock with aluminum gangway within Lake Wallenpaupack (HQ-CWF) and to construct and maintain a 6-foot wide x 31-foot long x 6-inch high concrete walkway lined with gabion stone and attached to a 6-foot wide x 14-foot long x 4-foot high concrete bulkhead to be lined with R-4 rip-rap.

 The bulkhead will be attached to a 4-foot wide x 40-foot long aluminum gangway accessing a proposed 384 square foot floating wooden dock within Lake Wallenpaupack (HQ-CWF) for the purpose of creating handicap accessibility, increased safety, and a more permanent dock structure.

 The project is located on the northern tip of Lake Wallenpaupack, approximately 0.4 miles south west of the intersection of SR 590 and US Route 6 (Hawley, PA Quadrangle Latitude: 41° 27` 34.8"; Longitude: -75° 11` 23").

E13-161. East Penn Township, 167 Municipal Road, Lehighton, PA 18235-3916, in East Penn Township, Carbon County, U.S. Army Corps of Engineers, Philadelphia District.

 To construct and maintain a 0.7-acre athletic sports field and two (2) pole building pavilions within the 100-year floodway of Lehigh River (TSF) for the purpose of creating a recreational area.

 The project is located on the south side of the SR 248, approximately 0.4 mile east of the intersection of T-337 and I-476 (Lehighton, PA Quadrangle Latitude: 40° 47` 30"; Longitude: -75° 39` 23").

E45-550. Suburban Realty, LP, P. O. Box 67, 1 River Road, Shawnee, PA 18356, in Smithfield Township, Monroe County, U.S. Army Corps of Engineers, Philadelphia District.

 To construct and maintain a 24-inch diameter stormwater outfall pipe to be installed perpendicular to an existing concrete wingwall and culvert structure, which currently passes Wigwam Run (HQ-CWF, MF) beneath Wigwam Park Road. The purpose of the project is to discharge stormwater associated with the Plaza 611 development.

 The project is located along the south side of T-469 (Wigwam Pond Road), approximately 0.2 mile north east of the intersection of SR 611 and T-469 (Saylorsburg, PA Quadrangle Latitude: 40° 59` 59"; Longitude: -75° 15` 41").

E13-162. Green Energy Capital Partners, LLC, 319 Barren Hill Road, Suite 400, Conshohocken, PA, in Nesquehoning Borough, Carbon County, U.S. Army Corps of Engineers, Philadelphia District.

 To construct and maintain: (1) a stormwater outfall structure consisting of an existing R-4 rip-rap apron within the 100-year floodway of Broad Run (HQ-CWF, MF); (2) a stormwater outfall structure consisting of an existing R-3 rip-rap apron within the 100-year floodway of Broad Run (HQ-CWF, MF); (3) an underground utility line stream crossing of Deep Run (EV, MF); and (4) and a temporary sediment basin discharge within the 100-year floodway of Nesquehoning Creek (HQ-WWF, MF) for the purpose of constructing an electricity generation solar park with visitors center.

 The project is located on the north side of the SR 54, approximately 5.9 miles west of the intersection of SR 93 and U.S. Route 209 (Nesquehoning, PA Quadrangle Latitude: 40° 51` 24"; Longitude: -75° 51` 21").

 All in-stream construction, operation and maintenance work shall be conducted in dry work conditions by dam and pumping, fluming or diverting stream flow around work areas. Since Davis Run is wild trout fishery, no construction or future repair work shall be done in or along the stream channel between October 1 and December 31 without prior written approval. The project is located along the western right-of-way of the SR 0219 approximately 720-feet north of Tenth Street and SR 0219 intersection.

E03-451. Mahoning Creek Hydroelectric Company, LLC, 150 North Miller Road, Suite 450C, Fairlawn, OH 44333. To construct a bridge and access road to maintain a power house and tailrace in Redbank and Wayne Townships, Armstrong County, Pittsburgh ACOE District (Distant, PA Quadrangle N: 8.4 inches; W: 4.4 inches, Latitude: 40° 55` 17"; Longitude: 79° 16` 55"). To construct and maintain a powerhouse and tailrace on the left bank of Mahoning Creek (CWF) located 1,200 feet downstream of the existing US Army Corps of Engineers Mahoning Creek Dam to accommodate a turbine generating system. The 40-foot wide, 150-foot long, 10-foot deep tailrace will be constructed downstream of the powerhouse to return the water back to the Mahoning Creek. The project includes construction of a ford crossing or a bridge on an access road and 2.2-mile long overhead transmission line within the existing Allegheny Power right-of-way.

E61-290, Aqua Pennsylvania, Inc., 665 South Dock Street, Sharon, PA 16146. Existing Water Treatment Plant Demo—New Water Pumping Station Construction, in Emlenton Borough, Venango County, ACOE Pittsburgh District (Emlenton, PA Quadrangle N: 41° 10` 36"; W: 79° 42` 46").

 The applicant proposes to demolish an existing water treatment plant located partially in the 100-year flood plain of the Allegheny River and to construct and maintain a new raw water pump station located in the 100-year flood plain of the Allegheny River approximately 125 feet southwest of the intersection of River Avenue and Main Street in Emlenton Borough, Venango County (N: 41° 10` 36"; W: 79° 42` 46"). The Allegheny River is a perennial stream classified as a warm water fishery.

FINAL ACTIONS TAKEN FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS

 The Department of Environmental Protection (Department) has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and Notices of Intent (NOI) for coverage under general permits. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92 and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1—691.1001) and the Federal Clean Water Act.

 Sections I—VI contain actions related to industrial, animal or sewage wastes discharges, discharges to groundwater and discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities and concentrated animal feeding operations (CAFOs). Section VII contains notices for parties who have submitted NOIs for coverage under general NPDES permits. The approval for coverage under general NPDES permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions set forth in each general permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective permit. Permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decision law.
