FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

 Persons with a disability who wish to attend the hearing and require an auxiliary aid, service or other accommodation to participate in the proceedings should contact the specified program. TDD users may contact the Department through the Pennsylvania AT&T Relay Service at (800) 654-5984.

WATER OBSTRUCTIONS AND ENCROACHMENTS

E18-459. James L. Berkibile, PO Box 394, Lock Haven, PA 17745-0394. After-the-Fact Riverfront Improvements, in Colebrook Township, Clinton County, ACOE Baltimore District (Farrandsville, PA Quadrangle N: 41°11`13.4"; W: 77°3`17.3").

 To construct and maintain: 1) 41.25 cubic yards of earthen fill and stonewalls for a 25-foot by 35-foot riverfront patio, 2) a 20-foot long by 24-foot wide open-sided pavilion on top of the patio to over-look the West Branch Susquehanna River and an at-grade 20-foot long by 24-foot wide by 4 inches thick concrete pad on top of the existing gravel patio surface, 3) a 6-foot wide by 30-foot long by 2-foot deep flood relief channel on the landward side of the patio area with the channel floor 6-inches higher in elevation than the normal water elevation in Holland Run, 4) a 5-foot wide by 10-foot long foot-bridge over this new relief channel to allow for access to the patio, all of which is located on the upstream left edge of Holland's Run confluence with the West Branch Susquehanna River, which is in the 100-year floodway of the river. This project proposes to indirectly impact 35 linear feet of the left streambank of Holland's Run, which is classified as a High Quality—Cold Water Fishery and 25 linear feet of the right floodway of the West Branch Susquehanna River, which is classified as a Warm Water Fishery.

E49-315. Northumberland Terminals Corporation, PO Box 2621, Harrisburg, PA 17105-2621. Northumberland East, in Point Township, Northumberland County, ACOE Baltimore District (Riverside, PA Quadrangle Latitude: 40-54-59.37; Longitude: 76-45-1.42).

 The proposed activity includes wetland and stream impacts. There are 400 linear feet of stream impacts associated with stream relocation, stabilization, and a vehicle crossing in an unnamed tributary to the Susquehanna River, Warm Water Fishery. The stream stabilization is proposing utilizing toe riprap and an imbricated rip-rap wall. The vehicular crossing is proposed to be a 1 foot by 5 foot box culvert crossing that is 45 linear feet long with a total stream impact of 65 linear feet, including the outlet apron and inlet protection. An aerial utility line will cross the unnamed Tributary to the Susquehanna River 23 feet above the stream due to also crossing a rail spur. The rail spur will permanently impact 0.51 acres of wetland. This is proposed to be mitigated with 0.83 acres of wetland creation located 1,500 feet southwest of the project area on the nearby Northumberland Terminals Corporation property.

E02-1649. Blank River Services, Inc, 1 Church Street, Elizabeth, PA 15037. To construct and maintain a barge mooring facility in Lincoln Borough, Allegheny County, Pittsburgh ACOE District. (Glassport, PA Quadrangle: N: 6.0 inches; W: 0.1 inch; Latitude: 40° 16` 59"; Longitude: 79° 52` 33") The applicant proposes to construct and maintain a barge mooring facility approximately 975.0 feet in length and 125.0 feet wide (as measured from the Normal Pool Elevation), consisting of six (6) pipe support structures and to perform periodic maintenance dredging in the channel and along the right bank of the Monongahela River (WWF) for the purpose of mooring barges. The project is located near River Mile 22, approximately 50.0 feet downstream from the confluence of the Monongahela River and Wiley Run.

ENVIRONMENTAL ASSESSMENTS

Central Office: Bureau of Waterways Engineering, Rachel Carson State Office Building, Floor 3, 400 Market Street, Harrisburg, PA 17105

EA1946-001. To remove an abandoned concrete water obstruction located in Fishing Creek, in the Borough of Bloomsburg and the Township of Hemlock. The owner and original purpose of the structure are unknown. The project goal is to remove the abandoned concrete water obstruction for the purpose of increasing the natural functions and services provided by Fishing Creek. The concrete structure is approximately 4 feet wide at its crest and varies between an estimated 10 feet to 20 feet wide at its base. The total length of the structure is approximately 590 feet. The abandoned water obstruction will be excavated and the excavated material will be placed directly into trucks for off-site disposal. Temporary discharge of fill material to construct equipment access causeways is required for safe ingress and egress during construction. The project area bounded by temporary construction easements totals approximately 1.19 acres and is within Fishing Creek and its floodway. The project is located approximately 1,200 lineal feet upstream of the Red Mill Road bridge over Fishing Creek in the Borough of Bloomsburg. (Catawissa, PA Quadrangle; 76° 28` 12.195" W ; 40° 59` 52.204" N).

 The Department has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and NOIs for coverage under General Permits. This notice of final action is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1—691.101) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 Sections I—VI contain actions regarding industrial, animal or sewage wastes discharges, discharges to groundwater, and discharges associated with MS4, stormwater associated with construction activities and CAFOs. Section VII contains notices for parties who have submitted NOIs for Coverage under General NPDES Permits. The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

 For individuals who wish to challenge an action, the appeal must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

STATE CONSERVATION COMMISSION NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

 The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

 Persons aggrieved by an action may appeal under 3 Pa.C.S. § 517, section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704 to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania AT&T Relay Service at (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decision law.

 For individuals who wish to challenge actions, appeals must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

 Important legal rights are at stake, however, so individuals should show this notice to a lawyer at once. Persons who cannot afford a lawyer may qualify for pro bono representation. Call the Secretary of the Board at (717) 787-3483 for more information.
