HAZARDOUS SITES CLEAN-UP UNDER THE ACT OF
OCTOBER 18, 1988

Notice of Proposed Interim Response

Berkley Products Company Plant Site, West Earl Township and Akron Borough, Lancaster County

 The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101—6020.1305) is proposing an interim response at the Berkley Products Company Plant Site, 405 South 7th Street, Akron PA 17501.

 The Berkley Products Company Site (Berkley) is located at 405 South 7th Street in West Earl Township and is bordered by the Borough of Akron, Lancaster County, Pennsylvania. The approximately 2.5 acre facility is located on a hillside sloping from South 7th Street at the front to South 9th Street at the rear. Residential properties surround most of the site, but a few commercial properties are also present. Berkley is an operating facility producing customized coatings and has manufactured coatings at the facility since 1955. During most of their operation, solvents were used as drying agents in the coatings and for cleaning the manufacturing equipment. In 1980, Berkley submitted a Part A Application for Resource Conservation and Recovery Act (RCRA) Interim Status as a treatment and storage facility. By then Berkley was blending waste for cement kiln fuel and consolidating waste for shipment to various disposal facilities. The waste streams included toluene, trichloroethene (TCE), other individual solvents and chemicals, and solvent and chemical mixtures. The facility is in the RCRA Corrective Action Program, but is financially unable to address environmental problems. Soil, groundwater, and surface water contamination have been identified.

 The proposed response will consist of excavation and offsite disposal of all contaminated soil that exceeds statewide health standards under Chapter 250 Title 25 of the Land Recycling and Remediation Standards Act. The Department considered consolidation and capping or excavation and off-site thermal desorption before selecting the proposed response. The proposed response for groundwater contamination consists of in-situ chemical oxidation of groundwater plume hotspots, enhanced in-situ bioremediation, institutional controls, and monitored natural attenuation. After the in-situ injections, continued monitoring and further injections as necessary to attain the groundwater statewide health standards will be conducted as operation and maintenance activities. Groundwater monitoring will be initiated to track the groundwater remediation progress. After groundwater has attained the remediation standards at the property boundary, monitored natural attenuation will over time return the groundwater beneath the plant property to the maximum beneficial use of the groundwater as the long term final remediation goal. Institutional controls will be utilized to restrict groundwater use and ensure the use of vapor mitigation systems installed in the affected and potentially affected residences under a previous HSCA interim response. The Department considered the proposed groundwater response actions individually and in alternate combinations before selecting the proposed response.

 The Department is providing this notice under sections 505(b) and 506(b) of HSCA (35 P. S. Sections 6020.505(b) and 6020.506(b), and the publication of this notice starts the administrative record period under HSCA. The Administrative Record which contains information about this site and which supports the Department's decision to perform this action at the site is available for public review and comment. The Administrative Record can be examined from 8 a.m. to 4 p.m. at the Department's Southcentral Regional Office located at 909 Elmerton Avenue, Harrisburg, PA 17110, by contacting David Hrobuchak, at (717) 705-4843. The Administrative Record may also be reviewed at the Akron Borough Municipal Office, 117 South Seventh Street, Akron, PA 17501, by calling (717) 859-1600.

 The Administrative Record will be open for comment beginning December 17, 2011, and will remain open for 90 days. Persons may submit written comments regarding this action to the Department before March 16, 2012, by mailing them to Mr. Hrobuchak at the Department's Southcentral Regional Office address.

 The public will have an opportunity to present oral comments regarding the proposed action at a public hearing. The hearing has been scheduled for January 25, 2012, at 7 p.m. at the Akron Elementary School, 125 South 11th Street, Akron, PA. Persons wishing to present formal oral comments at the hearing should register before 4 p.m., January 20, 2012, by calling Mr. Hrobuchak at the above number. An informational meeting will be held prior to the hearing.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995

PREAMBLE 2


The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).

 Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995

The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).

 Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

Walsh, P.G., Penn E&R, Inc, 2755 Bergey Road, Hatfield, PA 19440 on behalf of Bryan Cullen, Westrum Park Place, L.P. 370 Commerce Drive, Fort Washington, PA 19034 has submitted a Final Report concerning the remediation of site groundwater and soil contaminated with diesel fuel. The Final report did not demonstrate attainment of the Statewide Health Standard and was disapproved by the Department on October 21, 2011.

Box 1006, Easton, PA 18044 submitted a Final Report (on behalf of his clients, MHC Green Acres, LP, c/o Equity Lifestyle Properties, Inc., Two North Riverside Plaza, Suite 800, Chicago, IL 60606 and Ms. Jean Szoke, 8989 Breinigs Run Circle, Box 43, Breinigsville, PA 18031), concerning the remediation of soil found to have been impacted by No. 2 fuel oil/kerosene as a result of a an accidental release occurring from an aboveground storage tank, which is located outside the residential dwelling. The report documented attainment of the Residential Statewide Heath Standard for soil and was approved November 28, 2011.

John Lopatofsky 1V Well Site, Springville Township, Susquehanna County. David Testa and James Pinta, Jr., URS Corporation, 501 Holiday Drive, Foster Plaza 4, Suite 300, Pittsburgh, PA 15220 submitted a Final Report (on behalf of their client, Cabot Oil & Gas Corporation, Five Penn Center West, Suite 401, Pittsburgh, PA 15276), concerning the remediation of soil found to have been impacted by diesel fuel as a result of a drill rig fuel tank overfill during a fuel transfer from an auxiliary fuel tank. The report documented attainment of the Statewide Health Standard for soil and was approved on December 1, 2011. The report was originally submitted within 90 days of the release.

Drugas Property, 324 Beech Ridge Drive, Tobyhanna Township, Monroe County. Richard D. Trimpi, Trimpi Associates, Inc., 1635 Old Plains Road, Pennsburg, PA 18073 submitted a Final Report (on behalf of his client, Jennifer Lewis, 187 19th Avenue, Brick, NJ 08724), concerning the remediation of soil and groundwater found to have been impacted by kerosene oil as a result of a release from a 275-gallon aboveground storage tank's severed fuel supply line due to an act of vandalism. The report was submitted to document attainment of the Residential Statewide Health Standard for soil and groundwater. The applicant voluntarily withdrew the Final Report on December 1, 2011.

Box 22044, Lehigh Valley, PA 18002-2044 submitted a Final Report (on behalf of his client, George's P & H, Inc., RR 2, Box 25, Aquashicola, PA 18012), concerning the remediation of soil found to have been impacted by diesel fuel as a result of a release from a regulated 20,000-gallon aboveground storage tank's broken/failed cast iron ball valve. The report documented attainment of the Statewide Health Standard for soil and was approved on November 30, 2011. The report was originally submitted within 90 days of the release.

17-00046: HPM Industries, Inc.—Atlas Pressed Metals (125 Tom Mix Drive, DuBois, PA 15801) on November 18, 2011, to issue a state only operating permit for their powdered metal parts manufacturing facility in the City of DuBois, Clearfield County. The facility's main sources include five (5) sintering furnaces, a dip sizing operation, and an oil impregnation system. The facility has the potential to emit sulfur oxides (SOx), nitrogen oxides (NOx), carbon monoxide (CO), particulate matter with an aerodynamic diameter of 10 microns or less (PM10), volatile organic compounds (VOCs), and hazardous air pollutants (HAPs) below the major emission thresholds. The proposed operating permit contains all applicable requirements including Federal and State regulations. In addition, monitoring, recordkeeping and reporting conditions regarding compliance with all applicable requirements are included.

10-00369: ESM Special Metals & Technology, Inc. (955 Saxonburg Boulevard, Saxonburg, PA 16056) on November 29, 2011, for an initial Natural Minor Permit to operate a magnesium powder manufacturing facility in Clinton Township, Butler County. The facility's major emission sources include, Magnesium grinding / building 1, Magnesium grinding / building 2, Magnesium grinding / building 3, Magnesium grinding / building 4, Super Eddy current pulverizer, Powdered Magnesium transfer and storage, Emergency generator and parts washer. The emission of the pollutants from the facility is less than Title V threshold limits. Thus the facility is natural minor. The emergency generator is subject to 40 CFR Part 63, Subpart ZZZZ.

S11-020: National Publishing Co. (11311 Roosevelt Blvd, Philadelphia, PA 19154) on October 18, 2011, for operation of a printing facility in the City of Philadelphia, Philadelphia County. The facility's air emission sources include includes fourteen (14) 0.5 MMBTU/hr natural gas fired space heaters, four (4) lithographic presses with less than 8 MMBTU/hr natural gas fired dryers, and a 1.75 MMBTU/hr natural gas fired thermal oxidizer.

 The operating permit will be issued under the 25 Pa. Code, 3 Philadelphia Code and Air Management Regulation XIII.  Persons wishing to file protest or comments on the above operating permit must submit the protest or comments within 30 days from the date of this notice. The hearing notice will be published in the Pennsylvania Bulletin and a local newspaper at least thirty days before the hearing.

21-05002: PPG Industries, Inc. (400 Park Drive, Carlisle, PA 17013-9271) on November 30, 2011, to modify the Title V permit for their flat glass manufacturing facility in South Middleton Township, Cumberland County. The permit was modified, pursuant to Pa. Code § 127.463 to incorporate an alternative compliance schedule for the glass melting furnace NOx regulation, in accordance with 25 Pa. Code § 129.304(c)(2). Conditions were also added regarding AIMS reporting and electronic notification to EPA. Tempering Line 4 was removed from the permit. Standard CEM conditions were also added.

49-00030: Sunbury Textile Mills, Inc. (1200 Miller Street, City of Sunbury, PA 17801-0786) issued a revised state only operating permit on November 10, 2011 to incorporate restrictions on the usage of #2 fuel oil in their Series 600 L-591313 Cleaver Brooks Boiler and Series 300 Hurst Boiler at their facility is located in the City of Sunbury, Northumberland County. This state only operating permit contains all applicable regulatory requirements including monitoring, recordkeeping and reporting conditions.

49-00007: Cherokee Pharmaceuticals, LLC. (PO Box 367, Riverside, PA 17868), issued a revised Title V operating permit on November 8, 2011 for their pharmaceutical production facility located in Riverside Borough, Northumberland County. The revision of the Title V permit changed language of condition #003 and #007 of Source ID 180 to clarify the applicability of the throughput restriction in condition #003. Cherokee noticed the abovementioned changes to the public in The Daily Item on October 3, 2011. The Title V operating permit contains appropriate monitoring, recordkeeping and reporting conditions to verify compliance with the regulatory requirement in condition #003.

25-00179: Erie City Sewer Authority (68 Port Access Road, Erie, PA 16507-2299) for its facility located in the City of Erie, Erie County. The de minimis increases are a result of modifications to the existing ash silo. The Department has started a list of de minimis increases as prescribed in 25 Pa. Code § 127.449(i).

25-00967: Spectrum Control, Inc. (8061 Avonia Road, Fairview, PA 16415) on November 30, 2011, for revocation of their State Operating Permit for the electronic connector manufacturing facility in Fairview Township, Erie County. The plant removed the TCE degreaser (Source 102) which previously was approved under a plan approval. The facility has two degreasers that use N-Propyl Bromide and one degreaser that uses N-Methyl- pryrrolidone. The degreasers were exempt from plan approval because the VOC combined emissions are less than 2.7 TPY and there are no HAPs. The facility no longer requires a plan approval and the operating permit was therefore revoked.
