PUBLIC WATER SUPPLY (PWS) PERMITS

 Under the Pennsylvania Safe Drinking Water Act (35 P. S. §§ 721.1—721.17), the following parties have applied for PWS permits to construct or substantially modify public water systems.

 Persons wishing to comment on permit applications are invited to submit statements to the office listed before the application within 30 days of this public notice. Comments received within this 30-day comment period will be considered in the formulation of the final determinations regarding an application. A comment should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. Plan Description: The approved plan provides for the construction of new head-works and flow equalization (EQ) at the Waste Water Treatment Plant, re-rating of the existing facility to 2.9 MGD with inflow equalized to 4 MGD, construction of a 1 MGD EQ tank with a 7.2 MGD lift station at Liberty Street. Service will be extended to the Clarion-Limestone area school and the existing school treatment system will be abandoned. Additional collection/conveyance lines will be upgraded to accommodate additional flow, and supplemental ultra-violet disinfection will be added for peak flows. The project has been submitted as required under the October 30, 2008 Consent Order and Agreement between the Department, Pennsylvania American Water Company (PAWC) and the above listed tributary municipalities. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. Any required NPDES Permits or WQM Permits must be obtained in the name of PAWC.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995

PREAMBLE 1


Acknowledgment of Notices of Intent to Remediate Submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907)

 Sections 302—305 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.302—6026.305) require the Department to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. A person intending to use the background standard, Statewide health standard, the site-specific standard or intend to remediate a site as a special industrial area shall file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one or a combination of cleanup standards or receives approval of a special industrial area remediation identified under the act will be relieved of further liability for the remediation of the site for contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.

 Under sections 304(n)(1)(ii) and 305(c)(2) of the act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the following site, proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified as follows. During this comment period, the municipality may request that the person identified as the remediator of the site develop and implement a public involvement plan. Requests to be involved and comments should be directed to the remediator of the site.

 For further information concerning the content of a Notice of Intent to Remediate, contact the environmental cleanup program manager in the Department regional office listed before the notice. If information concerning this acknowledgment is required in an alternative form, contact the community relations coordinator at the appropriate regional office. Removal of an abandoned UST home heating oil tank and soil contaminated by No. 2 heating oil. The remediator is pursuing a statewide health residential standard. Notice was placed in the Herald Standard on October 19 2011.

AIR QUALITY

PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS NEW SOURCES AND MODIFICATIONS

 The Department has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.

 The Department received applications for Plan Approvals or Operating Permits from the following facilities.

 Copies of these applications, subsequently prepared draft permits, review summaries and other support materials are available for review in the regional office listed before the applications. Persons interested in reviewing the application files should contact the appropriate regional office to schedule appointments.

 Persons wishing to receive a copy of a proposed Plan Approval or Operating Permit shall indicate interests to the Department regional office within 30 days of the date of this notice and shall file protests or comments on a proposed Plan Approval or Operating Permit within 30 days of the Department providing a copy of the proposed documents to persons or within 30 days of its publication in the Pennsylvania Bulletin, whichever comes first. Interested persons may also request that hearings be held concerning a proposed Plan Approval or Operating Permit. 39-332-002: B Braun Medical Inc. (901 Marcon Blvd, Allentown, PA 18109) for the reactivation and operation of an ethylene oxide (ETO) sterilization unit at the facility located in Hanover township, Lehigh County. Presently the company operates ethylene oxide (ETO) sterilization process consisting of nine (9) ETO sterilization chambers (Units 101—109); eight (8) of which are currently operational at the facility. By this Plan Approval Application the company has requested reactivation of Unit 109. The company will continue use the wet scrubber and catalytic oxidizer to control the ethylene oxide emissions from the operations. Oxidizer and scrubbers are designed to control at least 99% of ETO emission or to maintain an outlet ETO concentration of less than or equal to 1 ppmv in accordance with 40 CFR Part 63, Subpart O. Use of wet scrubber and oxidizer to control ETO emissions would constitute the BAT for this type of source. The company is subject to 40 CFR Part 63, Subpart O—Ethylene Oxide Emissions Standards for Sterilization Facilities, and has been complying with the regulation since its effective date. Unit 109 will also be subject to the requirements of 40 CFR Part 63, Subpart O. The company will operate the facility and maintain the sources in accordance with the good engineering practices to assure proper operation of sources. The Plan Approval and Operating permit will contain additional recordkeeping and operating restrictions designed to keep the facility operating within all applicable air quality requirements.

66-329-012: Chief Gathering, LLC (6051 Wallace Road Ext., Suite 210, Wexford, PA 15090) for the construction and operation of a eight (8) Caterpillar G3608LE engines with Oxidation Catalyst and two (2) Glycol Dehydrators with reboilers controlled by a Thermal Oxidizer at its Hirkey Compressor Station facility in Lemon Township, Wyoming County. The plan approval will include all appropriate testing, monitoring, recordkeeping and reporting requirements designed to keep the operations within all applicable air quality requirements.

58-399-016: Laser Northeast Gathering Company LLC (333 Clay Street, STE 4500, Houston, TX 77002-4102) or their facility to be located in Liberty Twp., Susquehanna County.

 In accordance with 25 Pa. Code §§ 127.44(a) and 127.45(a), that the Department of Environmental Protection (DEP) has received and intends to issue a Plan Approval to Laser Northeast Gathering Company LLC (333 Clay Street, STE 4500, Houston, TX 77002-4102) for their facility to be located in Liberty Twp., Susquehanna County. This Plan Approval No. 58-399-016 will be incorporated into a Synthetic Minor Permit through an administrative amendment at a later date.

 Plan Approval No. 58-399-016 is for the construction of a natural gas compressor station at the Snake Creek FRP Site. The station will consist of two CAT G3606LE engines and two dehydrators with reboilers. The VOC emissions from the facility will not equal or exceed 50 TPY, based on a 12-month rolling sum. The NOx emissions from the facility will not equal or exceed 100 TPY, based on a 12-month rolling sum. Total PM, SOx, and CO emissions from the facility will not equal or exceed 100 TPY, based on a 12-month rolling sum. The HAPs from the facility must never equal or exceed 10 TPY of any single HAP and must never equal or exceed 25 TPY of all aggregated HAPs, based on a 12-month rolling sum. The Plan approval and Operating Permit will include testing, monitoring, record keeping and reporting requirements designed to keep the sources operating within all applicable air quality requirements.

 The facility is subject to MACT 40 CFR Part 63 Subparts ZZZZ and HH, NSPS Subpart JJJJ and 25 Pa. Code § 127.12(a)(5) Best Available Technology (BAT) requirements. The visible emission opacity shall not be equal to or greater than 20% at any time. The company shall be subject to and comply with 25 Pa. Code § 123.31 for malodorous emissions.

 Emissions from the engines will meet MACT Subpart ZZZZ, MACT Subpart HH, BAT & NSPS Subpart JJJJ requirements. The Plan Approval and Operating permit will contain additional recordkeeping and operating restrictions designed to keep the facility operating within all applicable air quality requirements.

 Copies of the application, DEP's analysis and other documents used in the evaluation of the application are available for public review during normal business hours at Air Quality Program, 2 Public Square, Wilkes-Barre, PA 18701-1915.

 Any person(s) wishing to provide DEP with additional information, which they believe should be considered prior to the issuance of this permit, may submit the information to the address shown in the preceding paragraph. Each written comment must contain the following:

The NOx emissions from the facility will not equal or exceed 100 TPY, based on a 12-month rolling sum. Total PM, SOx, and CO emissions from the facility will not equal or exceed 100 TPY, based on a 12-month rolling sum. The HAPs from the facility must never equal or exceed 10 TPY of any single HAP and must never equal or exceed 25 TPY of all aggregated HAPs, based on a 12-month rolling sum. 36-05146A: PPL Renewable Energy, LLC (Two North Ninth Street, Allentown, PA 18101) for the modification to the facility's operating permit for two landfill gas-fired Internal Combustion engines at the Frey Farm/Creswell Landfill in Manor Township, Lancaster County.

 In accordance with 25 Pa. Code §§ 127.44(a) and 127.45(a), the Department of Environmental Protection (DEP) has received and intends to issue a Plan Approval to the above mentioned company for the above mentioned project. This plan approval may be incorporated into the company's Title V operating permit via an administrative amendment at a later date.

 This plan approval authorizes the removal of the major source threshold limits for Hazardous Air Pollutants, incorporates Formaldehyde emission limits, and incorporates the requirements of 40 CFR Part 63, Subpart ZZZZ—National Emission Standards for Hazardous Air Pollutants for Stationary Reciprocating Internal Combustion Engines (RICE). The facility's annual emission rate is not expected to increase beyond their current permitted levels. The Plan Approval and Operating permit will contain additional testing, recordkeeping, and operating restrictions designed to keep the facility operating within all applicable air quality requirements. The project will not trigger PSD or NSR requirements.

08-00016B: Dalrymple Gravel and Contracting Co., Inc. (2105 South Broadway, Pine City, NY 14871) for a modification of the existing drum and batch mix asphalt plants at their Chemung Plant in Athens Township, Bradford County. The modification to the drum mix plant includes an installation of a new countercurrent flow drum and a new tri-fuel (natural gas, #2 fuel oil and waste oil) burner. The modification to the batch mix plant is to allow the use of waste oil (on-specification type) in the existing burner. The air contaminant emissions from the drum mix plant and the batch mix plant will be controlled by the existing fabric collector on each respective plant.

 The Department's review of the information contained in the application submitted by Dalrymple Gravel and Contracting Co., Inc. indicates that the sources and the air-cleaning devices will comply with all applicable air quality requirements pertaining to air contamination sources and the emission of air contaminants, including the best available technology (BAT) requirements of 25 Pa. Code §§ 127.1 and 127.12, the fugitive air contaminant emission requirement of 25 Pa. Code § 123.1, the visible emission limitation of 25 Pa. Code § 123.41, and 40 CFR 60, Subpart I requirements related to Standards of Performance for Hot Mix Asphalt Facilities. The plan approval, if issued, will subsequently be incorporated in an operating permit via an administrative amendment in accordance with 25 Pa. Code § 127.450 at a later date.

 Based upon this finding, the Department proposes to issue a plan approval for the modification of the existing drum and batch mix asphalt plants. The following is a summary of the types of conditions the Department intends to place in the plan approval to ensure compliance with applicable regulatory requirements.

 Drum mix plant:

 1. Pursuant to BAT, the drum plant shall be fired only on natural gas, #2 fuel oil and waste oil. The #2 fuel oil fired in this plant shall not contain sulfur in excess of 0.2% by weight. The waste fuel oil fired in this plant shall not contain sulfur in excess of 0.5% by weight. Additionally, the ash percentage (by weight) of the waste oil shall be less than 1.0%.

 2. Pursuant to BAT, the waste oil fired in this plant shall not contain contaminants in excess of the limitations specified below:

 8. Pursuant to BAT, the VOC emissions (expressed as methane) from the drum plant shall not exceed the following limitations for each of the fuel oil specified below.

 9. Pursuant to BAT, the total HAPs emissions from the plant shall not exceed 2.0 tons during any 12 consecutive month period.

 10. Pursuant to BAT, the quantity of asphalt produced shall not exceed 400,000 tons during any 12 consecutive month period.

 11. Pursuant to BAT, the drum plant shall not process RAP at a rate in excess of 50% of the total weight of all materials charged into the drum.

 12. Pursuant to BAT, this plant shall not be used to dry stone, other than when the plant is simultaneously producing asphalt concrete.

 13. Pursuant to BAT, the plant shall not be used to produce asbestos-containing asphalt material.

 14. Pursuant to BAT, this plant shall not used to decontaminate, or otherwise treat soil or any other material which has been contaminated with gasoline, fuel oil or any other substance.

 15. The air compressor supplying the cleaning air to the fabric collector shall be equipped with an air dryer and an oil trap.

 16. The fabric collector shall be equipped with instrumentation to continuously monitor differential pressure across the collector and inlet temperature.

 17. Appropriate stack test conditions in order to ensure compliance with the NOx, CO, and VOC limitations specified for each of the fuels approved herein. Additionally, appropriate stack test conditions in order to ensure compliance with the particulate matter and opacity standards specified by 40 CFR 60.92(a), as well as any limitations established herein.

 18. Appropriate recordkeeping conditions.

 19. All applicable requirements specified in Department's WDLF policy (Document No. 275-2101-009) relating to testing, sampling, reporting, monitoring, record- keeping requirements.

 20. All conditions contained in Operating Permit 08-00016 remain in effect unless superseded or amended by conditions contained herein. If there is a conflict between a condition or requirement contained in this plan approval and a condition or requirement contained in Operating Permit 08-00016, the permittee shall comply with the condition or requirement contained in this plan approval rather than the conflicting condition or requirement contained in Operating Permit 08-00016.

 Batch mix plant:

 1. The batch plant shall be fired only on natural gas, #2 fuel oil and reprocessed oil (waste oil). The waste fuel oil fired in this plant shall not contain sulfur in excess of 0.5% by weight. Additionally, the ash percentage (by weight) of the waste oil shall be less than 1.0%.

 2. The waste oil fired in the batch plant shall not contain contaminants in excess of the limitations specified below:

 4. The NOx emissions from the batch plant while firing waste oil shall not exceed 0.078 pounds per ton of product and 15.6 pounds per hour. Additionally, the NOx emissions from the plant shall not exceed 7.8 tons during any 12 consecutive month period.

 5. The SOx emissions from the batch plant while firing waste oil shall not exceed 0.056 pounds per ton of product and 11.2 pounds per hour. Additionally, the SOx emissions from the plant shall not exceed 5.6 tons during any 12 consecutive month period.

 6. The CO emissions from the batch plant while firing waste oil shall not exceed 0.129 pounds per ton of product and 25.8 pounds per hour. Additionally, the CO emissions from the plant shall not exceed 12.9 tons during any 12 consecutive month period.

 7. The VOC emissions from the batch plant while firing waste oil shall not exceed 0.032 pounds per ton of product and 6.4 pounds per hour. Additionally, the VOC emissions from the plant shall not exceed 3.20 tons during any 12 consecutive month period.

 8. The total HAPs emissions from the batch plant while firing waste oil shall not exceed 0.0076 pounds per ton of product and 1.5 pounds per hour. Additionally, the total HAPs emissions from the plant shall not exceed 0.76 tons during any 12 consecutive month period.

 9. The quantity of asphalt produced in the batch plant shall not exceed 200,000 tons during any 12 consecutive month period.

 10. Appropriate stack test conditions in order to ensure compliance with the NOx, CO, and VOC limitations specified while using waste oil. Additionally, appropriate stack test conditions in order to ensure compliance with the particulate matter and opacity standards specified by 40 CFR 60.92(a), as well as any limitations established herein.

 11. Appropriate recordkeeping conditions.

 12. All applicable requirements specified in Department's WDLF policy (Document No. 275-2101-009) relating to testing, sampling, reporting, monitoring, record- keeping requirements.
