THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

FINAL ACTIONS TAKEN FOR NPDES PERMITS AND WQM PERMITS

 The Department has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and NOIs for coverage under General Permits. This notice of final action is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1—691.101) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 Sections I—VI contain actions regarding industrial, animal or sewage wastes discharges, discharges to groundwater, and discharges associated with MS4, stormwater associated with construction activities and CAFOs. Section VII contains notices for parties who have submitted NOIs for Coverage under General NPDES Permits. The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

 For individuals who wish to challenge an action, the appeal must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

 Important legal rights are at stake, however, so individuals should contact a lawyer at once. Persons who cannot afford a lawyer may qualify for pro bono representation. Call the Secretary to the Board at (717) 787-3483 for more information.

 Description of Proposed Action/Activity: Part II Permit Amendment for Blossburg Municipal Authority STP. The permit has been amended to include the phosphorus removal system. To meet the Chesapeake Bay level of 0.8 mg/L and the existing total phosphorus level of 2.0 mg/L, the Authority proposes to use ferric chloride to remove phosphorus.

 This proposed facility is located in Ulysses Township, Potter County.

 Description of Proposed Action/Activity: The construction and installation of a new pump station wet well and sewer extension to serve the proposed addition of the Pennsylvania Lumber Museum of Galeton, PA. This will be a gravity and pressurized system that conveys the sewage to the existing Denton Hill State Park sewage treatment plant. The new construction will consist of gravity mains, pressure laterals, pressure force mains, a duplex individual grinder pump, a duplex grinder pump station utilizing the existing pumps, and a new 8' wet well. This project will also include minor upgrades to the controls at the pump station and Denton Hill plant.

This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

Plan Description: This Planning Module provides for the extension of Public Sanitary Sewer Service from existing Sanitary Manhole 2-2106 located at the intersection of Christian Springs Road and Brodhead Avenue, to twelve existing light industrial/commercial properties along Fritch Drive that currently utilize on-lot disposal systems. The Public Sewer Extension will also provide a means for future sewer services to seven adjacent properties along Tracy Lane and Brodhead Road that are also served currently by on-lot disposal systems.

 Flow projections identified in the Planning Module represent the ultimate wastewater flow of 39,034 gpd which encompasses the 19 total properties. The wastewater from the extension project will flow to the township's Pump Station #4 and then to conveyance facilities owned by the City of Bethlehem which will provide public sewage conveyance and treatment facilities as well as public water to the project.

 A developer has prepared the design and associated contract documents for the sewer extension. The developer will obtain all of the necessary permits and pay for the sewer extension construction.

 The individual property owners will be responsible for contracting with a plumber to install their own lateral to connect to the sewer main.

 The Griffin Land Development Project located in Lower Nazareth Township at the Northern end of Fritch Drive is not included in this Planning Module approval. A separate Planning Module submission from Lower Nazareth Township will be required for the Griffin Tract.

 It is the responsibility of Bethlehem Township to implement this Act 537 Planning Module Plan in accordance with the schedule contained in the Planning Module. Any required NPDES Permits or WQM Permits will be obtained by the private developer.

Plan Description:  The approved plan provides for the implementation of a Township wide on-lot sewage disposal system operation and management program. The Plan also provides for sanitary sewer extension numbers 1, 2A and 10 within 5 years, project numbers 2B, 3, 4B, and 11 within 10 years and project numbers 5B, 5C, 5D, 6A, 6B, 6C, 7A, 7B, 8, 9A, 9D and 9E within 20 years. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal.
