FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

 To perform the following water obstruction and encroachment activities associated with the replacement of the existing Delaware Road Bridge (S.R. 1016, Section BBR) over the Delaware Canal (WWF, MF):

 1. To remove the existing bridge, and to construct and maintain, in its place, a single span bridge approximately 28-foot 4-inches long, 54-foot span, and with 7-foot 4-inches underclearance.

 2. To construct and maintain a temporary a road crossing over the canal.

 To construct and maintain a stream and wetland enhancement project in and along approximately 900 feet of Ariel Creek and adjacent wetlands with work consisting of regrading and excavation within approximately 1.4 acres of wetlands and replanting approximately 5.1 acres of wetlands with native trees, shrubs and herbs. Impacted wetlands are located in the floodplain of Ariel Creek.  To remove the existing 24.0-inch diameter gas pipeline and install and maintain a 36.0-inch diameter high-strength carbon steel gas pipeline in and across: 1) four unnamed tributaries to Conococheague Creek (CWF, MF), 2) Stump Run (CWF, MF), 3) an unnamed tributary to West Branch Conococheague Creek (TSF, MF), 4) seven wetland crossings in the Conococheague Creek Watershed, being 66.0, 45.0, 41.0, 100.0, 31.0, 395.0, and 140.0 feet long (Start: Chambersburg, PA Quadrangle; N: 3.09 inches, W: 2.47 inches; Latitude: 39°53`31.3", Longitude: -77°38`33.3"; End: Scotland, PA Quadrangle; N: 4.94 inches, W: 1.22 inches; Latitude: 39°54`8.0", Longitude: -77°30`31.2") in Greene, Guilford, and Peters Townships, Franklin County. The purpose of the project is to provide additional natural gas supply diversity and security of supply. All impacts are temporary impacts and mitigation is not required.

 E08-478. Pennsylvania Department of Transportation, Engineering District 3-0, PO Box 218 Montoursville, PA 17754-0218. S.R. 4014 Section 21M Roadway Improvement and Paving Project, Smithfield Township, Bradford County, ACOE Baltimore District (East Troy, PA Quadrangle N: 41° 52` 28"; W: 76° 36` 46").

 PA DOT Engineering District 3-0 proposes to upgrade approximately a two-mile section of SR 0414. The project will include roadway widening, roadway paving and drainage upgrades. The project will impact seven Unnamed Tributaries to Peas Creek and six wetlands. The project proposes a total of 1768 Ft. of permanent impacts and 167 Ft. of temporary impacts to the Tributaries to Peas Creek. The project proposes a total of 0.12 acre of permanent impact to the wetlands and 0.08 acre of temporary impact to the wetlands. These impacts are the result of roadway widening, pipe replacements and channel modifications for streams located adjacent to the roadway. Unnamed Tributaries to Peas Creek are classified as Trout Stream Fishery by Title 25, Chapter 93 Water Quality Standards. The project will not require mitigation.

 E18-471. Pennsylvania Department of Transportation, Engineering District 2-0, 1924 Daisy Street Extension, Clearfield, PA 16830. SR 0477, Segment 0050, Offset 1398, Outfall to Long Run in Lamar Township, Clinton County, ACOE Baltimore District (Mill Hall, PA Quadrangle; Latitude: 41° 05` 05"; Longitude 76° 26` 55").

 The applicant proposes to install an 18-inch Outfall to Long Run and the associated Rip Rap Scour Protection. The outfall does not meet GP-4 criteria because Long Run is a special protection watershed. Long Run is classified as an Exceptional Value Stream. The project does not propose any impact to Jurisdictional Wetlands.

To construct an access road, associated with the Carlisle Well Site, crossing T32919 to Brush Run in Hopewell Township, Washington County, Pittsburgh ACOE District, State Water Plan Basin 20-E, (Washington West, PA Quadrangle; N inches; W inches; Latitude: N 40° 13` 03.00"; Longitude: W 80° 20` 05.56"), Wheeling—Buffalo Creeks Watershed. The applicant proposes to involve the installation of 42 linear feet of 48" culvert crossing the stream channel of T32919 to Brush Run (HQ-WWF) to serve as permanent access to R. Carlisle well site. Impacts include T32919 to Brush Run (HQ-WWF) approximately 42 linear feet of stream within the project area. The upstream watershed drainage at the access road crossing is approximately 282 acres (0.44 mi²).

 To construct and maintain a 14 foot long steel beam bridge having a clear span of 36 feet and an underclearance of 5 feet across Camp Run as a replacement for an existing ford on an access road within State Game Land 244 approximately 0.75 mile upstream of the mouth of Camp Run at Sandy Lick Creek.

 To construct and maintain approximately 1.51 acres of replacement wetlands involving excavation in the floodway of an unnamed tributary to the Shenango River (WWF). The replacement wetlands are proposed as mitigation for the wetland impacts associated with a 13 acre commercial development located in the City of Hermitage, Mercer County (N: 41°, 13`, 39.96"; W: 80°, 27`, 7.82") as detailed in the Joint Permit Application E43-354.

 To permanently fill approximately 0.958 acre of wetlands (0.60 acre PEM, 0.33 acre PSS, and 0.02 acre PFO) in the watershed of Bobby Run (WWF) for the construction of a 13 acre commercial development located southwest of the State Route 18 and State Route 62 intersection in the City of Hermitage. The applicant proposes to mitigate for the wetland impacts by constructing approximately 1.51 acres of replacement wetlands in the floodway of an unnamed tributary to the Shenango River (WWF) in New Wilmington, Lawrence County (N: 41°, 5`, 11.89"; W: 80°, 24`, 15.72") as detailed in the Joint Permit Application E37-188.
