STATE CONSERVATION COMMISSION

PROPOSED NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

 This notice provides information about agricultural operations that have submitted nutrient management plans (NMPs) for approval under 3 Pa.C.S. Chapter 5 and that have or anticipate submitting applications for new, amended or renewed NPDES permits, or Notices of Intent (NOIs) for coverage under a general permit, for CAFOs, under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

 Based upon preliminary reviews, the State Conservation Commission (SCC) or County Conservation Districts (CCD) working under a delegation agreement with the SCC have completed an administrative review of NMPs described. These NMPs are published as proposed plans for comment prior to taking final actions. The NMPs are available for review at the CCD office for the county where the agricultural operation is located. A list of CCD office locations is available at http://www.nacdnet.org/about/districts/directory/pa.phtml or can be obtained from the SCC at the office address listed or by calling (717) 787-8821.

 Persons wishing to comment on an NMP are invited to submit a statement outlining their comments on the plan to the CCD, with a copy to the SCC for each NMP, within 30 days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the NMPs. Comments should include the name, address and telephone number of the writer and a concise statement to inform the SCC of the exact basis of the comments and the relevant facts upon which they are based. Comments should be sent to the SCC, Agriculture Building, Room 310, 2301 North Cameron Street, Harrisburg, PA 17110.

PUBLIC WATER SUPPLY (PWS) PERMITS

 Under the Pennsylvania Safe Drinking Water Act (35 P. S. §§ 721.1—721.17), the following parties have applied for PWS permits to construct or substantially modify public water systems.

 Persons wishing to comment on permit applications are invited to submit statements to the office listed before the application within 30 days of this public notice. Comments received within this 30-day comment period will be considered in the formulation of the final determinations regarding an application. A comment should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held after consideration of comments received during the 30-day public comment period.

 Following the comment period, the Department will make a final determination regarding the proposed permit. Notice of this final determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

 The permit application and related documents are on file at the office listed before the application and available for public review. Arrangements for inspection and copying information should be made with the office listed before the application.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995
PREAMBLE 1


Acknowledgment of Notices of Intent to Remediate Submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907)

 Sections 302—305 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.302—6026.305) require the Department to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. A person intending to use the background standard, Statewide health standard, the site-specific standard or intend to remediate a site as a special industrial area shall file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one or a combination of cleanup standards or receives approval of a special industrial area remediation identified under the act will be relieved of further liability for the remediation of the site for contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.

 Under sections 304(n)(1)(ii) and 305(c)(2) of the act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the following site, proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified as follows. During this comment period, the municipality may request that the person identified as the remediator of the site develop and implement a public involvement plan. Requests to be involved and comments should be directed to the remediator of the site.

 For further information concerning the content of a Notice of Intent to Remediate, contact the environmental cleanup program manager in the Department regional office listed before the notice. If information concerning this acknowledgment is required in an alternative form, contact the community relations coordinator at the appropriate regional office. TDD users may telephone the Department through the AT&T Relay Service at (800) 654-5984.

Flynn Environmental, Inc., 5640 Whipple Avenue NW, Suite 1, North Canton, OH 44720, on behalf of Sisters of the Humility of Mary, 225 Villa Maria Road, Villa Maria, PA 16155, submitted a Final Report concerning remediation of site soils and groundwater contaminated with Benzene, Toluene, Ethylbenzene, Cumene, MTBE, Naphthalene, 1,2,4 Trimethylbenzene, and 1,3,5 Trimethylbenzene. The report is intended to document remediation of the site to meet the Statewide Health Standard.

NLMK Pennsylvania Corporation (Fmr. Duferco Farrell Corporation Facility), 15 Roemer Boulevard, City of Farrell, Mercer County. Cummings/Riter Consultants, Inc., 300 Penn Center Boulevard, Suite 800, Pittsburgh, PA 15235 on behalf of NLMK Pennsylvania Corporation, 15 Roemer Boulevard, Farrell, PA 16121, submitted a Final Report concerning the remediation of site soils contaminated with Arsenic, Barium, Cadmium, Chromium, Iron, Lead, Selenium, Silver, Zinc, PCB—Aroclor 1254, PCB—Aroclor 1260, and Mercury. The Report is intended to document remediation of the site to meet the Site-Specific Standard.

AIR QUALITY

PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS NEW SOURCES AND MODIFICATIONS

 The Department has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.

 The Department received applications for Plan Approvals or Operating Permits from the following facilities.

 Copies of these applications, subsequently prepared draft permits, review summaries and other support materials are available for review in the regional office listed before the applications. Persons interested in reviewing the application files should contact the appropriate regional office to schedule appointments.

 Persons wishing to receive a copy of a proposed Plan Approval or Operating Permit shall indicate interests to the Department regional office within 30 days of the date of this notice and shall file protests or comments on a proposed Plan Approval or Operating Permit within 30 days of the Department providing a copy of the proposed documents to persons or within 30 days of its publication in the Pennsylvania Bulletin, whichever comes first. Interested persons may also request that hearings be held concerning a proposed Plan Approval or Operating Permit. A comment or protest filed with the Department regional office shall include a concise statement of the objections to the issuance of the Plan Approval or Operating Permit and relevant facts which serve as the basis for the objections. If the Department schedules a hearing, a notice will be published in the Pennsylvania Bulletin at least 30 days prior the date of the hearing.

46-0281: Matheson Tri-Gas (1700 Scepter Road, Waverly, TN 37185) for installing a new distillation process and a thermal oxidizer to control volatile organic compound (VOC) emissions from a gas purification and cylinder filling operation in its Palm facility in Upper Hanover Township, Montgomery County. This facility is a synthetic minor facility. The facility wide volatile organic compound (VOC) emissions and combined hazardous air pollutant (HAP) emissions will be limited to below 25 tons per year. Individual HAP emissions will be limited to below 10 tons per year. The Plan Approval and Operating Permit will contain emission limitations, operating restrictions, work practice, monitoring, and recordkeeping requirements designed to keep the facility operating within all applicable air quality requirements.

06-05081A: Delaware County Solid Waste Authority (583 Longview Road, Boyertown, PA 19512) for the construction of a leachate distillation system at the Rolling Hills Landfill in Earl Township, Berks County.

 In accordance with 25 Pa. Code §§ 127.44(a) and 127.45(a), the Department of Environmental Protection (DEP) has received an application and intends to issue a Plan Approval to the abovementioned company for the abovementioned project.

 Plan Approval No. 06-05081A will provide for the construction of a leachate distillation system that will be powered by a 150 HP boiler that will be operated by the use of landfill gas that will be diverted from the enclosed ground flare. Along with the existing emission limits, the plan approval will contain monitoring, recordkeeping, reporting and work practice standards to ensure the facility complies with all applicable air quality requirements.The estimated air emissions from the project are less than 1 ton per year of all criteria pollutants, and 12 tons per year of ammonia.

 Copies of the application, DEP's analysis and other documents used in the evaluation of the application are available for public review during normal business hours at Air Quality Program, 909 Elmerton Avenue, Harrisburg, PA 17110.

 A person may oppose the proposed plan approval, or may provide the Department with additional information to consider in its review, by filing a written protest with the Department at the address listed above. Each written comment must contain the name, address and telephone number of the person submitting the comments, identification of the proposed permit by the permit number listed above and a concise statement regarding the relevancy of the information or objections to the issuance of the permit.

 Pursuant to 25 Pa. Code §§ 127.44(b) and 127.424(b), the Department of Environmental Protection (DEP) intends to issue Plan Approval 43-270H to CCL Container Corporation for the replacement of the control device for Sources 106 through 109 and the replacement of the control device for sources 101 through 105. This facility is located in City of Hermitage, Mercer County. The Plan Approval will subsequently be incorporated into the facility Operating Permit through an administrative amendment in accordance with 25 Pa. Code § 127.450.

 Plan Approval No. 39-00099A is for the construction and operation of an energy production facility. The facility will utilize municipal solid waste (MSW) and sludge from the City of Allentown's Wastewater Treatment Plant as feedstock to produce a fuel to generate 4 gross megawatts (MW) of electricity for internal use and sale. The facility will be designed with equipment capable of processing an average of 120 tons/day of Municipal Solid Waste (MSW) and 47 tons/ day sewage sludge as feedstock. Feedstock for the facility will be prepared onsite from MSW and sludge. The facility will use presorting of the MSW to increase the recovery of recyclables and state-of-the-art technology Resource Recovery System (RRS) to convert feedstock to a renewable clean fuel that will be combusted using an improved Stoker-type combustor to generate steam, which in turn will power a turbine to generate a green, renewable source of electricity.

 The facility will consist of the following processes. Receiving & Sorting, Shredding, Feedstock Pit, Five (5) Resource Recovery System Units, Dryer, Combustor (CCC), Boiler, Turbine/Generator and Wastewater Treatment System (WTS).

 The facility will emit Clean Air Act-regulated pollutants, including PM10, NOx, CO, SO2, VOC, acid gases and metals. The emission control system consists of the following devices in series: twin cyclones for primary PM removal, selective catalytic reduction (SCR) system with urea injection for NOx control, economizer, flue gas recirculation for NOx control, fabric filter for control of PM and metals control, wet packed tower with caustic solution recirculation for control of SO2, HCl, and HF, 2-stage carbon adsorption system for VOC and mercury control.

 After control, the following are estimated emissions from the facility.

 c. HCl- 0.13 lb/hr, 0.5 tons/yr. in any 12-month period, rolling monthly.

 d. CO- 3.5 lb/hr, 13.4 tons/yr. in any 12-month period, rolling monthly.

 e. VOCs- 1.04 lb/hr, 4.0 tons/yr. in any 12-month period, rolling monthly.

 f. SOx- 1.89 lb/hr, 7.3 tons/yr. in any 12-month period, rolling monthly.

 g. Hg- 0.0015 lb/hr, 0.006 tons/yr. in any 12-month period, rolling monthly.

 4. Pursuant to the Best Available Technology provision of 25 Pa. Code §§ 127.1 and 127.12(a)(5), visible emissions shall not exceed 10 percent opacity for periods aggregating more than 3 minutes in any 60-minute period, except during startup, when visible emissions may not exceed 20 percent opacity for periods aggregating more than 3 minutes in any 60-minute period. Visible emissions may not equal or exceed 30 percent opacity at any time.

 5. The storage and handling of the material associated with the aforementioned source(s) shall not at any time result in the emission of fugitive air contaminants in excess of the limitations specified in Section 123.1 of Chapter 123 of the Rules and Regulations of the Department of Environmental Protection.

19-00009: Deluxe Building Systems, Inc. (499 West Third Street, Berwick, PA 18603-2936) for renewal of the State Only (Synthetic Minor) Operating Permit for their Berwick Plant located in Berwick Borough, Columbia County. The subject facility has the following potential emissions: 2.13 TPY of CO; 5.0 TPY of NOx; 0.032 TPY of SOx; 1.48 TPY of PM; 0.64 TPY of PM10; <50 TPY of VOCs; <25 TPY of HAPs; <10 TPY of any individual HAP and 6,413 TPY of CO2e. The facility's sources include one (1) plumbing operation, one (1) sealant operation, one (1) adhesive operation, three (3) surface coating operations, three (3) petroleum storage tanks, one (1) cold degreaser, one (1) welding operation, one (1) concrete panel operation and miscellaneous space heaters.

 The emission restriction, testing, monitoring, record- keeping, reporting and work practice conditions of the SMOP have been derived from the applicable requirements of 25 Pa. Code Chapters 121—145.

 The renewal State Only (Synthetic Minor) operating permit contains applicable regulatory requirements including monitoring, recordkeeping, and reporting conditions to ensure compliance with applicable Federal and State air quality regulations.

24-00001: Buehler Lumber Co. (260 West Main Street, Ridgway, PA 15853) to issue a renewal of the State Only Operating Permit for the sawmill in Ridgway Boro, Elk County. The facility is a Natural Minor. The facility primary sources include a biomass boiler rated at 20 mmbtu/hr controlled by a multi cyclone, miscellaneous woodworking operations, stockpiling, lumber grading operation controlled by a cyclone, and a wood moulder controlled by a baghouse The boiler is subject to the requirements of 40 CFR 60, Subpart Dc—NSPS for Industrial, Commercial, and Institutional Steam Generating Units and 40 CFR 63, Subpart JJJJJJ—NESHAP for Industrial, Commercial, and Institutional Boilers at Area Sources. The PM, SOx, NOx, CO, and VOC and HAP emissions are less than major thresholds. The renewal permit contains emission restrictions, recordkeeping, work practice, and additional requirements to ensure compliance with the Clean Air Act and the Air Pollution Control Act.

33-00174: Brownlee Lumber Co. (2652 Hazen Richardsville Road, Brookville 15825) to renew a State Only Operating Permit for the facility located in Warsaw Township, Jefferson County. The primary sources at the facility are a 125 hp wood boiler and saw mill operations. Potential Emissions for the site are less than the Title V thresholds. The facility is a Natural Minor. The boiler is subject to 40 CFR Part 63 Subpart JJJJJJ, the NESHAP for Area Source Boilers. The permit contains emission restrictions, recordkeeping, and work practice requirements to ensure compliance with the Clean Air Act and the Air Pollution Control Act.

43-00309: Bucks Fabricating, Inc. (3547 Perry Highway, Hadley, PA 16130) to renew a State Only Operating Permit for the roll-off container fabricating facility located in Sandy Creek Township, Mercer County. The primary sources at the facility are cleaning and coating operations, two paint booths, and a 13 kW propane-fueled emergency generator. Potential Emissions for the site are less than the Title V thresholds. The facility is a Natural Minor. The permit contains emission restrictions, recordkeeping, and work practice requirements to ensure compliance with the Clean Air Act and the Air Pollution Control Act.

This Plan Approval No. 48-00092A will be incorporated into a State Only Permit through an administrative amendment at a later date.

 Plan Approval No. 48-00092A is for the increase in coating usage. VOC emissions form the plant will remain under 50 TPY threshold limit, 12-month rolling sum. Particulate emissions will not exceed 0.04 grain/dscf. The company shall be subject to and comply with 25 Pa. Code § 129.52 for VOC emission limits. Total HAP emissions from the facility will be under 25 TPY, 12-month rolling sum. Single HAP emissions will be under 10 TPY, 12-month rolling sum. The company shall be subject to and comply with 25 Pa. Code § 123.31 for malodorous emissions. The company shall be subject to and comply with 25 Pa. Code § 123.41 for Visible emissions. Emissions will be controlled by the use of a dry filters. These limits will meet BAT requirements for this source. The Plan Approval and Operating permit will contain additional recordkeeping and operating restrictions designed to keep the facility operating within all applicable air quality requirements.

The company shall be subject to and comply with 25 Pa. Code § 123.31 for malodorous emissions. These limits will meet BAT requirements for this source.
