Environmental Protection Performance Standards at Oil and Gas Well Sites; Advance Notice of Final Rulemaking; Public Comment Period Extension

 By this notice, the public comment period on the Draft Final Rulemaking: Environmental Protection Perform- ance Standards at Oil and Gas Well Sites rulemaking is extended to May 19, 2015. In addition to the comment period extension, the Department of Environmental Protection (Department) will be holding three public hearings on the draft final rulemaking to gather public comments.

 The hearings will be held from 6 p.m. to 9 p.m. on the following dates:

 Persons wishing to present testimony at a hearing are requested to contact the Department's Policy Office at (717) 783-8727 in advance of the hearing to reserve time to present testimony. Witnesses are requested to submit three written copies of their verbal testimony to the hearing chairperson at the hearing. Organizations are limited to designating one witness to present on their behalf at each hearing.

 Testimony is limited to 5 minutes for each witness. Witnesses will be called to testify in the order they registered. If time permits at the hearing, those who did not register in advance will be given the opportunity to testify.

 Persons in need of accommodations as provided for in the Americans with Disabilities Act of 1990 should contact the Department at (717) 783-8727 or through the Pennsylvania AT&T Relay Service at (800) 654-5984 (TDD) or (800) 654-5988 (voice users) to discuss how their needs may be accommodated.

 The draft final rulemaking is available electronically through the Department's web site at www.dep.state.pa.us (Select ''Oil and Gas Rulemaking'' button).

 The Department requests that commentators focus their comments on language that is changed from the proposed rulemaking and that comments be submitted separately for each chapter to aid in comment review and response. The Department particularly seeks comments on the issues of the definition of ''other critical communities'' (§§ 78.1 and 78a.1), noise mitigation (§ 78a.41) and centralized tank storage (§§ 78.57a and 78a.57a).

 Written or electronic comments will be accepted through May 19, 2015. Electronic comments may be submitted through the Department's Online Regulatory Comment System at http://www.ahs.dep.pa.gov/RegComments or by e-mail to RegComments@pa.gov. Written comments should be sent to the Department of Environmental Protection Policy Office, 400 Market Street, P. O. Box 2063, Harrisburg, PA 17105-2063. Comments must be received by May 19, 2015. A subject heading of the rulemaking and a return name and address must be included in each letter or transmission. Comments will not be accepted by facsimile or voice mail.
