LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995
PREAMBLE 3


The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).

 Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

 For further information concerning the plans and reports, contact the environmental cleanup program manager in the Department regional office under which the notice of the plan or report appears. If information concerning a final report is required in an alternative form, contact the community relations coordinator at the appropriate regional office. Indiana Work Center, 76 Airport Road, White Township, Indiana County. Leidos Engineering, LLC., 180 Gordon Drive Suite 109, Exton, PA 19341 on behalf of Verizon Pennsylvania, LLC., 966 South Matlack Street, West Chester, PA 19382 submitted a Remedial Investigation/Final Report concerning the remediation of site groundwater contaminated with BTEX and chlorinated solvents and site soils contaminated with tetrachloroethylene and chloroform. The RIR/FR demonstrated attainment of residential Statewide Health standard for groundwater and Site Specific standard for soil and was approved by the Department on June 26, 2015.

Former Invensys Appliance Controls (formerly: Siebe Appliance Controls; Robert Shaw Controls), One Westinghouse Drive, Borough of New Stanton, Westmoreland County. CB&I Environmental Infrastructure, Inc., 2790 Mosside Boulevard, Monroeville, PA 15146 on behalf of Schneider Electric, 33 Commercial Street, C42-2G, Foxboro, MA 02035 submitted a Baseline Risk Assessment concerning the remediation of site soils and groundwater contaminated primarily with chlorinated solvents and volatile organic compounds. The Baseline Risk Assessment was approved by the Department on June 26, 2015.

REGISTRATION FOR RESIDUAL WASTE GENERAL PERMITS


Registration for General Permit issued under the Solid Waste Management Act (35 P. S. §§ 6018.101—6018.1003); and Residual Waste Regulations for a General Permit to Operate Residual Waste Processing Facilities (25 Pa. Code § 287.611 relating to authorization for general permit).

South Central Regional Office: Waste Management Program, 909 Elmerton Avenue, Harrisburg, PA 17110-8200.

General Permit No. WMGR109-SC007. Keystone Holdings, LLC, 2850 Appleton Street, Camp Hill, PA 17011-8039. The Department of Environmental Protection has approved a registration under General Permit WMGR109 to Keystone Holdings, LLC for the processing and beneficial use of used restaurant oil, yellow grease, grease trap waste, oil and animal fats from food processing or rendering plants, waste from ethanol production, soy bean soap stock, float grease (from wastewater treatment plants), and off-specification vegetable oil for use as a biofuel or biodiesel. This Registration is for their location at 2850 Appleton Street, Camp Hill, PA 17011-8039 in Lower Allen Township, Cumberland County. The permit for this facility was issued on June 25, 2015.

DETERMINATION OF APPLICABILITY FOR RESIDUAL WASTE GENERAL PERMITS

Determination of Applicability for coverage under the General Permit was issued in the Regional Office on June 23, 2015.

GP3-06-03165: Liberty Excavators, Inc. (4402 Gettysburg Road, Camp Hill, PA 17011) on June 25, 2015, for a portable nonmetallic mineral processing plant under GP3 at the Conestoga Landfill, in New Morgan Borough, Berks County.

GP11-06-03165: Liberty Excavators, Inc. (4402 Gettysburg Road, Camp Hill, PA 17011) on June 25, 2015, for three nonroad engines under GP11, to power portable nonmetallic mineral processing equipment at the Conestoga Landfill, in New Morgan Borough, Berks County.

This action is a renewal of the State Only Operating Permit. The initial permit was issued on 8-12-2004 and was renewed on 7-30-2009. The permit is for a non-Title V, Synthetic Minor facility. The permit will include monitoring, recordkeeping, reporting, and work practice standards designed to keep the facility operating within all applicable air quality requirements.

46-00281: Matheson Tri-Gas, Inc. (1700 Scepter Road, Waverly, TN 37185) On June 29, 2015 for operating an industrial gas manufacturing plant in Upper Hanover Township, Montgomery County. This is an initial State-Only Operating Permit that includes emission restrictions, monitoring, recordkeeping and reporting requirements designed to ensure this facility in compliance with all applicable Federal and state air quality regulations.

40-00036: SAPA Extruder, Inc. The sources consist of natural gas fired boilers, anodizing tanks, and deburring machines. The sources are controlled by wet scrubbers, a cyclone, and a baghouse. This is a renewal of a State-Only operating permit. The State-Only operating permit includes emission limits, work practice standards, testing, monitoring, recordkeeping and reporting requirements designed to keep the facility operating within applicable air quality requirements.

54-00080: Hexcel Corporation (P. O. Box 179, Pottsville, PA 17901-0179) issued on 06/23/2015, for the operation of an aircraft manufacturing facility in East Norwegian Township, Schuylkill County. The operation consists of heat treating, machining, and cleaning of parts. This is a renewal of a State-Only operating permit. The State-Only operating permit includes emission limits, work practice standards, testing, monitoring, recordkeeping and reporting requirements designed to keep the facility operating within applicable air quality requirements.

04-00727: Five Points Veterinary Clinic/Crematory (2057 Brodhead Road, Aliquippa, PA 15001) on June 22, 2015 the Department issued a State Only Operating Permit for the operation of an animal crematory located in Hopewell Township, Beaver County. Five Points Veterinary Clinic operates a natural gas incinerator with after burner chamber. This facility has the potential to emit 0.52 tpy PM, 0.99 tpy CO, 0.18 tpy SOx, 0.38 tpy NOx, and 0.23 tpy VOC. This facility is subject to the applicable requirements of Pennsylvania Code, Chapters 121—145.

This facility is located in Monroe Township, Bradford County.  To upgrade, reconstruction, and maintenance of existing 21 and 27-inch sanitary sewer interceptors, siphons, and manholes to service portions of Aston and Middletown Townships. The project is referred to as the Middletown Township Sewer Authority's Chester Creek Interceptor Phase 1 Project. The interceptor will have three crossings of Chester Creek, one crossing of Chrome Run, and three crossings of wetlands (totaling 337 linear feet). The 8,410 linear feet sewer will be located in the 100-year floodplain/floodway as will six siphon chambers and 34 manholes. These stream and wetland crossings will be authorized under a GP-5. A single temporary access road to the Chrome Run crossing is authorized with a GP-8. The floodway and floodplain impacts are authorized by the 105/106 Water Obstructions and Encroachment Permit.  For the purpose of constructing an ethane cracker and associated derivative plants, and to relocate a portion of SR 18, in an approximately 665 acres project area, of which approximately 543 acres will be disturbed. The project will cumulatively impact approximately 16,838 lf of forty-one (41) watercourses and 3.63 acres of forty (40) wetlands. The project will also impact approximately 1.29 acre of the Ohio River from maintenance dredging, near the East RORO dock, West LOLO dock and the existing intake structure. In addition, the project will temporarily impact approximately 381 lf of regulated waters of the Commonwealth and 0.70 acre of wetland. The project is located at 300 Frankfort Road, Monaca, PA 15061 (USGS Quadrangle: Beaver, PA; Latitude: 40° 40` 20"; Longitude: -80° 20` 20"), in Potter and Center Townships, Beaver County. To mitigate for these impacts, approximately 17,674 lf of watercourses within the watersheds of three (3) unnamed tributaries to the South Fork of Cross Creek (HQ-WWF) will be restored or enhanced, and approximately 6.42 acres of wetland will be re-established or restored, at off-site locations, which are located near 905 Avella Road, Avella, PA 15312 (USGS Quadrangle: Avella, PA Latitude: 40° 16` 19.47" and Longitude: -80° 25` 40.04"; Latitude: 40° 16` 25.63" and Longitude: -80° 25` 21.81"; Latitude: 40° 16` 29.73" and Longitude: -80° 24` 58.19"), in Cross Creek Township, Washington County. The project is located along Maxwell Drive, approximately 0.20 miles north of its intersection with Fulton View Road (Latitude: 39° 49` 12.14"N; Longitude: 76° 09` 29.86"W) in Drumore Township, Lancaster County. Wetland impacts are temporary and replacement is not required.

Big Spring Creek is a special protection water of the Commonwealth and has an existing use of High-Quality Cold Water Fishes and Migratory Fishes under 25 Pa. Code, Chapter 93. The suspended NPDES Permit's Erosion and Sediment Control Plan and Post-Construction Stormwater Management Plan provide proposed effluent limitations. In their public hearing request, the public hearing requesters describe a concern regarding the protection of groundwater and stormwater runoff from the site, causing water pollution to Big Spring Creek.

 Pursuant to the Pennsylvania Environmental Hearing Board's (EHB) March 3, 2015 Order issued at EHB Docket No. 2014-028-L, the Department republished public notice of the suspended NPDES Permit on March 28, 2015 in the Pennsylvania Bulletin. Pursuant to the EHB's order, the approved NPDES Permit was suspended until further notice from the Department to allow the public adequate opportunity to comment on the suspended NPDES permit.

 The hearing will now be held on Wednesday, August 19, 2015, from 7:00 p.m. to 9:00 p.m. at the Cumberland County Conservation District office, 310 Allen Road, Carlisle, PA 17013.

 During the public hearing, individuals will have an opportunity to present up to 5 minutes of oral testimony regarding the proposal. Written comment will also be accepted and can be mailed to Scott Williamson at the Department's Southcentral Regional Office, 909 Elmerton Ave., Harrisburg, PA 17110 through the close of business Thursday, September 3, 2015. The Department will provide a written response to all significant testimony or written comment provided during the public hearing and public comment period. The Department will consider all comments in review of the application.

 Those who wish to present oral testimony can register by calling Tim Fuller at (717) 705-4706 by 12:00 p.m. on August 19, 2015, or individuals may register prior to the hearing that evening.  The suspended permit, materials, and supporting documents, including the Erosion and Sediment Control Plan, Post-Construction Stormwater Management Plan, relating to the suspended Lewis Martin NPDES permit may be inspected at the Department's Southcentral Regional Office during regular business hours by contacting the file room at the Southcentral Regional Office at (717) 705-4732.
