Actions on applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1—1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301—3326); The Clean Streams Law; the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51—30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1—1406.20a). FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984.  To construct the below-listed water obstruction and encroachments associated with the northeast extension of the Pennsylvania Turnpike and the replacement of the Harleysville's Pike Bridge (SR 0113) over an unnamed tributary of Skippack Creek (TSF). Specific Water Obstruction and Encroachment activities associated with this project are:

 1. To replace and maintain the existing three-span continuous multi-beam bridge with a proposed two-span composite concrete spread box beam bridge which carries Harleysville's Pike Bridge (SR 0113) over an unnamed tributary of Skippack Creek.

 2. To fill approximately 0.002 acre of palustrine wetlands (Wetland W9) to facilitate the construction of the proposed bridge wingwalls (Wing A) at the southwest approach of the bridge.

 3. To impact approximately 18 linear feet (279 square feet) of stream by extending an existing 36-inch diameter pipe to facilitate the proposed roadway widening. (Waterway S13).

 4. To replace and extend a 36-inch ACCMP diameter pipe with accompanied construction of a rock apron at the discharge point impacting approximately 64 linear feet of stream (471 square feet). (Waterway S15).

 5. To relocate approximately 150 feet section of the stream to provide for the construction of a proposed 150 feet retaining wall (2,171 square feet). (Waterway S15).

 The project is located approximately 150 feet northeast of the intersection where SR 0113 passes over the PA Turnpike Northeast Extension in Franconia Township, Montgomery County (Telford, PA, Quadrangle Latitude 40°18`01", Longitude 75°22`12").

 The issuance of this permit also constitutes approval of a Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

E09-984. Warrington Township, 852 Easton Road, Warrington, PA 18976-1413, Warrington Township, Bucks County ACOE Philadelphia District.

 To rehabilitate approximately 1,250 linear feet of existing UNT to Little Neshaminy Creek stream channel (WWF); and to replace 160 linear feet of an existing 48 inch RCP pipe and 142 linear feet of an existing 60 inch RCP pipe between Blackhorse Drive and Palomino Drive Crossings (Ambler, PA USGS; Lat. 40.239 inches; Long. -75.1302).

 The issuance of this permit also constitutes approval of a Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

E46-1121. Montgomery County—Division of Parks, Trails and Historic Sites, Montgomery County Court House, P. O. Box 311, Norristown, PA 19404-0311, Upper Providence Township, Montgomery County, ACOE Philadelphia District.

 1. To construct and maintain a proposed canoe/kayak launch pad with rip-rap adjacent to the Schuylkill River (WWF/MF) and within its floodway and floodplain.

 2. To construct and maintain a proposed observation platform with rip-rap adjacent to the stream.

 3. To construct and maintain an ADA (Americans with Disability Act of 1990) Access Fixed Fishing Pier with rip-rap.

 4. To construct and maintain a Rustic Bank Fishing Area.

 6. To construct and maintain approximately 1,440 linear feet and approximately 8.5 feet wide bituminous paved ADA Access and Trails.

 7. To redevelop and maintain the front yard of the Visitors Center to create an ADA walkway and a central lawn.

 The project site is located immediately south of the intersection of River and Black Rock Roads in Upper Providence Township, Montgomery County (USGS Phoenixville, PA, Quadrangle Latitude 40°09`38"; Longitude -75°30`26").

 The issuance of this permit also constitutes approval of a Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

EA15-013. Brandywine Valley Association, 1760 Unionville-Wawaset Road, West Chester, PA 19382, Uwchlan Township, Chester County, ACOE Philadelphia District.

 To perform the following water obstruction and encroachment activities along approximately 784 linear feet of an unnamed tributary to the East Branch Brandywine Creek (locally Ludwig's Run (Perennial, WWF, MF):

 1. Installation of in-stream stabilization structures including rock crossvanes, log crossvanes and root wads.

 2. Streambank grading for the establishment of a floodplain bench.

 3. Installation of native riparian plantings for stabilization and enhancement efforts outside of the channel.

 4. Temporary impacts to wetlands associated with the proposed streambank grading and installation of temporary stream crossings.

 The southern limit of the site is located near the intersection of Norwood Road and Beech Street (Down-ingtown, PA USGS Quadrangles, Latitude 40.034576 N"; Longitude -75.681071 W").

 The issuance of this permit also constitutes approval of a Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

E23-521. City of Philadelphia, Philadelphia International Airport, Terminal D-E Philadelphia International Airport, Philadelphia, PA 19153, Tinicum Township, Delaware County, ACOE Philadelphia District.

 To construct and maintain an approximately 1,500-foot extension of the existing runway 27L and the demolition and reconfiguration of various taxiways to accommodate aircraft access to the extended runway departure threshold. To relocate existing fuel lines, expand the vehicle service road network, install new electrical duct banks for new lighting and navigational aids, and modify the existing stormwater drainage system, including repair or replacement of an existing, poorly functioning tide gate. The total project area is approximately 260 acres and includes several temporary contractor staging and equipment storage areas.

 The site is located at Philadelphia International Airport (Woodbury, NJ, USGS; Latitude: 39.871672; Longitude: -75.237847).

 The issuance of this permit also constitutes approval of a Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

Notice of Planning Grant Awards under Section 901 of the Municipal Waste Planning
Recycling and Waste Reduction Act of 1988, Act 101

 The Department of Environmental Protection (DEP) hereby announces the following grants to counties pursuant to the Pennsylvania Municipal Waste Planning, Recycling and Waste Reduction Act of 1988, Act 101, P. L. 556, Section 901 and Section 208 of the Waste Tire Recycling Act/Small Business and Household Pollution Prevention Act (Act 190 of 1996).

 Planning grants are awarded to counties for 80% of approved costs for preparing municipal waste management plans as required by Act 101, for carrying out related studies, surveys, investigations, inquiries, research and analysis, including those related to siting, environmental mediation, education programs on pollution prevention and household hazardous waste and providing technical assistance to small businesses for pollution prevention. Grants may be awarded for feasibility studies and project development for municipal waste processing or disposal facilities, except for facilities for the combustion of municipal waste that are not proposed to be operated for the recovery of energy. All grant awards are predicated on the receipt of recycling fees required by Sections 701 and 702 of Act 101, and the availability of monies in the Recycling Fund.

 The Department will hold a public hearing on the draft NPDES permit renewal application at the LaBelle Volunteer Fire Department, located in Luzerne Township at 1101 LaBelle Road, LaBelle, PA 15450 on Friday, December 4, 2015, from 1:00 p.m. to 3:00 p.m. The nature of the public hearing is to solicit concerns and comments regarding the draft NPDES permit renewal for the LaBelle Site. The public hearing will be held in accordance with 25 Pa. Code § 92a.83.

 The public hearing is being held at the request of the Citizens Coal Council (CCC) and Environmental Integrity Project (EIP), who state the draft permit is insufficient under the Clean Water Act and fails to achieve water quality standards because:

 • It fails to include some of the most polluting point source discharges from the Matt Canestrale Contracting, Inc. site.

 • It uses the coal refuse technology-based limits for a host of other pollutants which are likely to be in the waste streams from the site.

 • DEP did not consider whether water-quality based limits are necessary when it is clear that the current technology-based limits are not sufficient to prevent violations of the water quality standards.

 • DEP failed to carry out a comprehensive reasonable potential analysis on the tributaries of the Monongahela.

 A Department representative will be available to receive both written and oral testimony regarding the draft NPDES permit. Testimony will be placed into public record for the draft NPDES permit and considered by Department staff in the review process.

Water Obstruction and Encroachment Permit Received

CDO-007 Major Amendment. Consol Pennsylvania Coal Company LLC, 1000 Consol Energy Drive, Canonsburg, PA 15317. Templeton Fork Stream and Wetland Mitigation Area, East Finley and West Finley Townships, Washington County, Pittsburgh ACOE District (Claysville, PA Quadrangle, Templeton Fork project area centroid latitude 40° 00` 16" N, Longitude 80° 25` 47" W). A major amendment is proposed to Permit CDO-007 previously approved on July 13, 2015. The applicant proposes to offset the stream and wetlands affected by the Enlow Fork Mine Oak Spring Slope and Supply Yard located in East Finley and West Finley Townships, Washington County, by developing a restoration site along a portion of Templeton Fork Stream located near Templeton Fork Road (T-414) intersection with T-408.

 This is a Chapter 105 Water Obstruction and Encroachment permit application and 401 Water Quality Certification request.

 Written comments or objections on the request for Section 401 Water Quality Certification or to the issuance of the Water Obstruction and Encroachment Permit may be submitted to the Department within 30 days of the date of this notice to the California District Office, 25 Technology Park, Coal Center, PA 15423, Phone: 724.769.1100.
