LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995
PREAMBLE 3


The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).

 Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

 For further information concerning the plans and reports, contact the environmental cleanup program manager in the Department regional office under which the notice of the plan or report appears. If information concerning a final report is required in an alternative form, contact the community relations coordinator at the appropriate regional office. The Final Report demonstrated attainment of the Statewide Health Standard, and was approved by the Department on December 31, 2015.

T. Allred Trucking, US Route 15S Trout Run exit ramp, Lewis Township, Lycoming County. Northridge Group, Inc., P. O. Box 231, Northumberland, PA 17857, on behalf of T. Allred Trucking, P. O. Box 135, Trinity, NC 27370 has submitted a Final Report concerning the remediation of site soils contaminated with BTEX and other Diesel Fuel parameters. The Final Report demonstrated attainment of the Statewide Health Standard, and was approved by the Department on January 13, 2016.

The Reports did not demonstrate attainment of the Site Specific Standard, and were disapproved by the Department on January 14, 2016.

Former Waynesboro Pipe Manufacturing Facility, 315—317 Hamilton Avenue, Borough of Waynesboro, Franklin County. CB & I Environmental & Infrastructure, Inc., 500 Penn Center Boulevard, Suite 1000, Pittsburgh, PA 15235, on behalf of Waynesboro Pipe Products, c/o Invensys LLC, 33 Commercial Street, Foxboro, MA 02035, submitted a Final Report concerning remediation of site soils and groundwater contaminated with PCBs, VOCs, SVOCs and Inorganics. The Final Report demonstrated attainment of the Residential Statewide Health Standard, and was approved by the Department on January 14, 2016.

Northwest Elementary School/Lebanon School District, Old Forge Road, Lebanon, PA 17042, City of Lebanon, Lebanon County. Reliance Environmental, Inc., 235 North Duke Street, Lancaster, PA 17602, on behalf of Lebanon School District, 1000 South 8th Street, Lebanon, PA 17042 and Aspens, Inc., 411 Chestnut Street, Lebanon, PA 17042 submitted a Remedial Investigation Report and Cleanup Plan concerning remediation of site soils and groundwater contaminated with metals and SVOCs. The Remedial Investigation Report and Cleanup Plan were disapproved by the Department on January 20, 2016.

USPS Former Harrisburg Vehicle Maintenance Facility, 800 Mulberry Street, Harrisburg, PA 17104, City of Harrisburg, Dauphin County. ARM Group, Inc., 1129 West Governor Road, PO Box 797, Hershey, PA 17033-0797, on behalf of US Postal Service, 7029 Albert Pick Road, 3rd Floor, Greensboro, NC 27409, submitted a Final Report concerning remediation of site soils and groundwater contaminated with PAHs and VOCs. The Final Report did not demonstrate attainment of the Background and Nonresidential Statewide Health Standards, and was disapproved by the Department on January 19, 2016.

A separate municipal waste processing permit shall be obtained from the Department to produce exceptional quality biosolids-derived material.

 1. As a soil additive or soil substitute;

 2. As an agricultural liming material;

 3. As a horticultural amendment;

 4. As a fertilizer for utilization in normal farming operations or land applied on disturbed lands to facilitate re-vegetation for land reclamation purposes; or

 5. As an ingredient or a component of the value-added topsoil material produced off-site provided that all requirements below are met.

 a. There is market or disposition for the material;

 b. The value-added material shall be transferred in good faith as a commodity in trade for use in lieu of a commercially available product; and

 c. The processing (i.e., blending, combining) of value-added topsoil material is authorized under a separate municipal waste processing permit issued by the Department unless:

 i. The amount of exceptional quality biosolids-derived material received for the production of value-added topsoil does not exceed 1,000 cubic yards;

 ii. The finished value-added material produced and stored by the processing operation does not exceed 7,500 cubic yards; and

 iii. The pre- and post-processing of value-added topsoil material is not accumulated speculatively.

 The general permit was issued by Central Office on January 27, 2016.

09-00105: Naceville Materials, Inc. (483 Springfield Street Coopersburg, PA 18036) On January 21, 2015 for the modification of a State Only, Synthetic Minor Operating Permit in Springfield Township, Bucks County. Naceville Materials operates an Asphalt Plant at this site.

 Naceville Materials has requested to decrease the maximum production rate of asphalt from 375 tons per hour to 255 tons per hour. This is based on the results from the source test conducted on September 29, 2014 which indicated that the company was not able to operate at maximum routine operating conditions required by the operating permit. Also, the company has requested to increase the percentage of recycled asphalt pavement (RAP) from 22.5% per hour to 25.0% per hour. During the source test the company operated at a rate of 25% RAP. Since Naceville Materials demonstrated that they can operate at 25% RAP and remain below their permitted emission limits the Department can approve the increase in RAP percentage.

 There are no changes to any other conditions and no emissions in the modification of the operating permit. The facility maintains a synthetic minor operating status by maintaining total NOx emissions to less than 22.50 tons per year. The modified permit also still includes testing, monitoring, recordkeeping and reporting requirements designed to keep the facility operating within all applicable local, state, and federal air quality requirements.

The relocated tributary will be 2,060 feet in length. Within the relocated tributary, the project proposes to install and maintain a 72 lineal feet, 2 feet tall by 4 feet wide, depressed 6 inches, baffled, concrete box culvert and 40 cross rock vane grade control structures. Permanent impacts to wetlands include 0.035 acre of PEM wetlands and 0.008 acre of PEM/PSS wetlands. The wetland impacts are deminimus and no mitigation is being required.  To construct and maintain a 1,952 linear foot stream restoration project on West Branch Susquehanna River (CWF, MF) Porter Run (CWF, MF), consisting of the installation of fish habitat structures to recreate a low flow meandering channel to reduce erosion and improve sediment transport while providing fish and wildlife habitat. The project is located completely within the limits of the Northern Cambria Flood Protection Project. The West Branch Susquehanna River portion begins at the Barr Avenue Bridge (Latitude: 40° 39` 28"; Longitude: -78° 47` 5") and extends 2,500 feet downstream to the Buza Memorial Bridge (Latitude: 40° 39` 53"; Longitude: -78° 47` 6"). Intent to Issue Plan Approval—IPAOP

AMS 15253: (Philadelphia Energy Solutions (PES) 3144 Passyunk Avenue, Philadelphia, PA 19145) for the Tier 3 Project. The Tier 3 Project will make several operational and process changes to comply with the U.S.E.P.A. Tier 3 gasoline standards. The changes will allow PES to meet the regulatory standards by performing additional sulfur-removal from finished gasoline, straight run naphtha, and other gasoline blending streams currently generated and processed at the refinery. The changes are not expected to provide for increased net production of gasoline, but rather will provide more intensive processing of existing refinery streams. Major project activities will include: (1) installation of low NOx burners on three existing process heaters (each 74 MMBTUs/hr or greater); (2) replacement of a 45.5 MMBTU/hr process heater with a 70 MMBTU/hr (refinery gas) process heater equipped with ultra low NOx burners (ULNB); (3) installation of a 110 MMBTU/hr process heater (refinery or natural gas) equipped with ULNB; and (4) installation of heat exchangers, valves, reactors and rerouting piping.

 From the project, there will be a potential increase of 11.2 tpy of NOx, 69.7 tpy of CO, 6.7 tpy of VOCs, 12 tpy of PM, and 4 tpy of SO2. The plan approval will contain emission limits, work standard practices, monitoring, recordkeeping, and reporting requirements to ensure operation within all applicable requirements.
