FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

EA17-017. Curwensville Municipal Authority Anderson Creek Abandon Sanitary Sewer Obstruction Removal Project, 900 Susquehanna Avenue, Curwensville, PA 16830. Three Abandon Sanitary Sewer Encasement Obstructions of Anderson Creek, Curwensville Borough, Clearfield County, ACOE Baltimore District (Curwensville Quadrangle; Latitude 40° 59` 52" N; Longitude 78° 31` 25" W).

 Curwensville Municipal Authority is seeking Department approval to remove three abandon concrete encased sanitary sewer crossings of Anderson Creek that prohibit navigability and aquatic species passage. Anderson Creek is designated a Cold Water Fishery (CWF) and Migratory Fishery (MF) by Department Chapter 93 Rules and Regulations. Complete and successful removal of the three below listed abandon structures shall include, but not be limited to, (1) demolition and removal of the concrete encasements, (2) removal of the inoperable sanitary sewers (3) restoration of scoured downstream bed elevations with appropriately sized native rock choked with excavated streambed materials to transition with unaffected downstream bed elevations, and (4) stabilize disturbed streambanks with R-8 rock. As proposed, removal of the abandon concrete encased sanitary sewers pose cumulative temporary impacts of 390-feet with no wetland impacts being incurred.

 The Tinglepaugh Pipeline project consists of constructing approximately 6.14 miles of 16" steel natural gas gathering line located in Gibson and Herrick Townships, Susquehanna County. The project will result in 665 lineal feet of temporary stream impacts, 9,760 square feet (0.22 acre) of temporary wetland impacts, and 924 square feet (0.02 acre) of permanent wetland impacts all for the purpose of providing safe reliable conveyance of Marcellus Shale natural gas to market.

 The Applicant proposes to permanently fill approximately 0.11 acre of wetlands within the floodplain of Scholars Run for the protection and expansion of the parking area around the Bi-Lo gas station at a point approximately 400 feet southwest of the U.S. Route 19 and Little Creek Road intersection. The Applicant proposes to mitigate for the wetland impacts by constructing approximately 0.11 acre of on-site replacement wetlands.

Project description and location: This project involves the discharge of supernatant from the Fort Mifflin Confined Disposal Facility (FMCDF) to the Schuylkill River. The FMCDF is located in Philadelphia County, and is owned by the United States Army Corps of Engineers (USACE). The project involves maintenance dredging of certain port facilities owned by Philadelphia Regional Port Authority (PRPA) and the placement of dredged material into the FMCDF. The dredging and placement, including the operation of the CDF in such a manner as to retain the dredged material and prevent it returning to the River in the discharge, will be conducted by a contractor to be retained by PRPA.

 Prior to issuance of the final state water quality certification, DEP will consider all relevant and timely comments, suggestions or objections submitted to DEP within 14 days of this notice. The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P.S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law).  Description of Proposed Action/Activity:

 The installation of four-hundred fifty (450) feet of 96 inch diameter steel reinforced pipe with a volume of approximately 169,200 gallons. The purpose of the project is to provide additional storage capacity to limit combined sewer overflows at CSO Outfall # 18 as per the Authority's Combined Sewer Overflow Long Term Control Plan.

 Description of Proposed Action/Activity:

 -Four (4) existing 250,000-gallon influent storage tanks; one with a new jet mixing system.

 -Existing grit chamber, neutralization tank, two (2) flocculation tanks and two (2) gravity plate separators.

 -Two (2) 63,500-gallon pre-anoxic tanks converted from two (2) existing clarifiers.

 -New 5,000-gallon methanol storage tank with chemical feed system.

 -Two (2) existing 264,000-gallon aeration tanks with new jet aeration systems replacing existing fine bubble aeration systems.

 -Two (2) new cross-flow tubular ultrafilter membrane systems (each with three (3) membrane modules).

 -New membrane clean-in place (CIP) system consisting of a cleaning tank, hot/cold water storage tanks, chemical metering system for caustic, sodium hypochlorite and citric acid based cleaning chemicals.

 -Conversion of the existing phosphoric acid feed system from manual operation to an automatically controlled.

 -New flow splitter boxes for pre-anoxic tanks and aeration tanks.

 -New two (2) plate-and frame heat exchangers for cooling the activated sludge biomass.

 -Elimination of two (2) existing sand filters.

 -New effluent flow meter and flow-proportional composite sampler.

 -Existing outfall structure.

NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

 The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

 Persons aggrieved by an action may appeal under 3 Pa.C.S. § 517, section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704 to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania AT&T Relay Service at (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin. PUBLIC WATER SUPPLY PERMITS

 The Department has taken the following actions on applications received under the Pennsylvania Safe Drinking Water Act (35 P.S. §§ 721.1—721.17) for the construction, substantial modification or operation of a public water system.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

 For individuals who wish to challenge an action, the appeal must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

 Important legal rights are at stake, however, so individuals should show this document to a lawyer at once. Persons who cannot afford a lawyer may qualify for free pro bono representation. Call the Secretary to the Board at (717) 787-3483 for more information.

WA 14-473B, Water Allocations. State College Borough Water Authority, 1201 West Branch Rd., State College, PA 16801, Harris Township, Centre County. This Water Allocation Permit grants State College Borough Water Authority the right to withdraw a maximum of 500,000 gallons per day (gpd) from the existing Shingletown Gap Reservoir on Roaring Run in Harris Township, Centre County. The allocation granted takes into account reasonable projections of future use that can be supported by past data. In addition, the allocation is limited by the safe yield of the source.
