FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483.  To construct and maintain a vegetated outfall channel with a riprap lined energy dissipater within the floodway of Little Lehigh Creek (HQ-CWF, MF). The channel has an 8-foot bottom width, 3:1 side slopes and is lined with a high performance turf reinforcement matting. Also associated with the project is work consisting of excavation and placement of fill in approximately 0.86 acre of the floodway of Little Lehigh Creek. (Allentown East, PA Quadrangle Latitude: 41°35`21.1"; Longitude: -75°29` 11.8").

E40-795. Presidential Land Holdings, LLC, 95 South Main Road, Mountain Top, PA 18707, in Rice Township, Luzerne County, U.S. Army Corps of Engineers, Baltimore District.

 To construct and maintain a 28-foot wide road crossing of an Unnamed Tributary to Wapwallopen Creek (CWF, MF) consisting of a 60-foot long, 8.5-foot diameter corrugated metal culvert, concrete wing walls, and R-6 riprap apron blended with streambed material. The culvert will be depressed 12 inches below streambed elevation. The project is located along the south side of Heslop Road, approximately 0.3 mile southeast of the intersection of Wilderness Drive and Heslop Road (Wilkes-Barre West, PA Quadrangle, Latitude: 41° 9` 48"; Longitude: -75° 55` 20").

E48-438. Valley Industrial Properties, LLC, c/o Mr. Steven J. Kolbe, 21 East 10th Street, Northampton, PA 18067. East Bangor Borough, Northampton County, Army Corps of Engineers Philadelphia District.

 To fill 0.42 acre of existing/abandoned shallow water-filled, slate quarry holes, 1.50 acre of PEM/PFO/PSS wetlands, and 278 linear feet of intermittent channels for the purpose of eliminating a safety hazard and preparing the site for potential future development. The permittee is required to provide 1.50 acre of replacement wetlands.

 The project is located at 2 Capital Boulevard, approximately 0.4 mile northeast of the intersection of Capital Boulevard and State Route 512 (Stroudsburg, PA Quadrangle; Latitude: 40° 52` 55" N, Longitude: -75° 11` 20" W) in East Bangor Borough, Northampton County. 1.50 acre of offsite wetland mitigation is proposed along Mack Road (Latitude: 40° 51` 06" N, Longitude: -75° 16` 40" W) in Plainfield Township, Northampton County.

 To 1) fill 0.92 of an acre of wetlands; and 2) enclose 1,603 linear feet of Unnamed tributary to Fishing Creek (TSF) for the purpose of constructing two warehouse buildings totaling 1,836,289 square feet and appurtenant features on a property in Newberry Township, York County (Latitude 40.155278, Longitude -76.827778). The permit was issued on April 9, 2018.

E67-936: Norfolk Southern Railway, 1200 Peachtree Street, Atlanta, GA 30309 in East Manchester Township, York County, U.S. Army Corps of Engineers, Baltimore District.

 To regrade approximately 0.46 of an acre of emergent wetland in order to access and assess a railroad bridge for maintenance. The project is located on an access road off Wago Road (York Haven, PA Quadrangle, Latitude: 40.094494 Longitude: -76.701539) in East Manchester Township, York County. The project area is intended to remain an emergent wetland, therefore no mitigation is required. The permit was issued on April 6, 2018.

 1. Place and maintain compacted structural fill material which will impact approximately 5.2 acres of floodplain of the Unnamed Tributary to Painters Run (WWF).

 2. To construct and maintain 1,000 feet of watercourse along an Unnamed Tributary to Painters Run to convey flood flows.

 3. Temporarily impact 1.7 acre of floodplain during construction.

E26-378, Plenary Walsh Keystone Partners, 2000 Cliff Mine Road, Park West Two, Third Floor, Pittsburgh, PA 15275, German Township, Fayette County, Pittsburgh ACOE District.

 Has been given consent to:

 1. Remove an existing 25` long, 17` wide bridge with a 4.2` underclearance from Middle Run (WWF).

 2. Construct, operate, and maintain a replacement 51.7` long, 24` wide, 4` high concrete box culvert within Middle Run.

 3. Place an additional approximately 1 foot of fill over an existing 47 LF 18" diameter culvert within an Unnamed Tributary of Middle Run (aka UNT1) (WWF).

 4. Remove a 14 LF section of an existing 146 LF, 30" diameter culvert within and reconstruct 20 LF of a second Unnamed Tributary of Middle Run (aka WWF) (UNT 2).

 Mitigation for the impacts will be restoration and maintenance of the structure. The project is to replace the existing S.R. 3013 over Middle Run (WWF) which is located at the intersection of Riffle Hollow Road and Harley Hill Road, (Carmichaels, PA USGS Topographic Quadrangle; Latitude: 39° 54` 6"; Longitude: -79° 53` 35" ; Sub-basin: 19C, Pittsburgh Army Corps District) in German Township, Fayette County.

E10-08-016, Mountain Gathering, LLC, 810 Houston St., Fort Worth, TX 76102. Prager Natural Gas Pipeline, in Summit Township, Butler County, ACOE Pittsburgh District, Saxonburg, PA Quadrangle N: 40°, 49`, 29.75"; W: 79°, 49`, 52.44".

 The project consists of installation of a 6,698 ft. long, 10-inch natural gas pipeline that will be installed via open trench for the entire length. The proposed project impacts in Butler County include a total of 63 linear feet of temporary impacts and 12 linear feet of permanent impacts to UNT's of Coal Run WWF. The project also has 0.006 acre of permanent impacts to Palustrine Scrub Shrub (PSS), and 0.001 acre of permanent impact to Palustrine Emergent (PEM) wetland(s), and 0.049 acre of temporary impacts to Palustrine Emergent (PEM) wetland(s). One floodway will be impacted having 0.107 acre of temporary impacts and 0.0003 acre of permanent impacts.

 The project consists of installation of a 6,731 ft. long, 10-inch steel water line that will be installed above ground for most of the proposed alignment. The proposed project impacts in Butler County include a total of 73 linear feet of temporary impacts to UNT's of Coal Run WWF. The project also has 0.044 acre of temporary impacts to Palustrine Emergent (PEM) wetland(s). One floodway will also be impacted having 0.328 acre of temporary impacts.

Permit Modification Proposed Under the Solid Waste Management Act (35 P.S. §§ 6018.101—6018.1003); the Municipal Waste Planning, Recycling and Waste Reduction Act (53 P.S. §§ 4000.101—4000.1904); and Residual Waste Regulations for a General Permit to Operate Residual Waste Processing Facilities and the Beneficial Use of Residual Waste other than Coal Ash.

General Permit No. WMGR103. The Department of Environmental Protection (Department) is proposing modifications to Residual Waste General Permit WMGR103. This general permit authorizes the processing by (i) grinding, mixing, screening and biological decomposition of tree stumps, roots, leaf waste, stump grindings, and grubbing material for the beneficial use as a mulch material and (ii) grinding, screening and mixing of freshwater dredged material from Seyferts basin, spent mushroom substrate, leaf waste, water treatment residual and waste foundry sand (authorized under WMGR019 or WMGR098) with uncontaminated soil for beneficial use as a manufactured topsoil. The proposed amendments include the reorganization and reformatting of the general permit for overall clarity and ease of use.

 This request, received October 11, 2017, is entitled Major Modification 1—East Swedesford Road—HDD S3-381. It involves a change in installation methodology for a portion of the project as a result of concerns raised by Aqua America (Aqua), the local water authority, regarding their Hillside Drive production well along East Swedesford Road. The permitted activity is located in West Whiteland Township.

 Specifically, the proposed changes include an open trench installation with five conventional bore sections and one short horizontal directional drill (HDD). The HDD will be conducted from Stream S-B79 and Lincoln Highway which is over 2,300 feet from Swedesford Road. Conventional bores will be added at Stations 15111+00 to 15112+25 (Exton Lane), Stations 15113+75 to 15117+00 (utilities avoidance), Stations 15121+00 to 15122+25 (East Swedesford Road), and Stations 15135+00 to 15137+00 (sensitive area by stream S-B81) and 15137+00 to 15141+00 (stream S-B81 and wetland WL-B71).

 Through the utilization of these alternative installation methods, SPLP proposes to avoid impacts to local resources and sensitive areas.

 The Department is aware of the significant public interest in this modification and has extended the time period for accepting written comments on this Chapter 102 permit modification request through Friday, May 11, 2018. This modification request is a change in installation methodology for a portion of the project following more in-depth hydrogeology analysis and seismic testing. The permitted activity is located in West Whiteland Township.

 Specifically, the proposed changes include an open trench installation with four conventional bore sections. Conventional bores will be added at Stations 15083+50 to 15085+50 (CH-0209 Parking Lot), Stations 15088+50 to 15089+50 (Stream S-C61), Stations 15092+00 to 15093+00 (Stream S-C59) and Stations 15093+50 to 15096+00 (Pottstown Pike/PA HWY 100).

 After obtaining additional information, SPLP proposes to use these alternatives methods to avoid impacts to local resources and sensitive areas.

Chapter 102 Erosion and Sediment Control Permit Modifications; Pennsylvania Pipeline
Project (PPP)/Mariner East II; Public Hearing

 The Department of Environmental Protection (Department) will hold a public hearing to receive comments from citizens on two Chapter 102 Erosion and Sediment Control Permit Modification applications currently under technical review for Pennsylvania Pipeline Project (PPP)/Mariner East II. These permit modifications are required for earth disturbance associated with the project.

 The hearing will be held on Monday, April 30, 2018, at E N Peirce Middle School, 1314 Burke Road, West Chester, PA 19830. The public hearing will begin at 6:30 p.m. and end at 9:30 p.m.

 The proposed permit modifications currently under review are identified as Major Modification 1—East Swedesford Road, HDD S3-381 and Major Modification 2—North Pottstown Pike, HDD S3-370. The modification applications request changing the installation methodology from horizontal direction drilling in these identified areas to a combination of open trenching, conventional boring and limited horizontal directional drilling. These modification requests are a result of concerns raised by a local water authority and/or further hydrogeology analysis and seismic testing. Due to the limited scope of the subject matter and time available for the hearing, commenters are asked to focus their remarks on the modifications under review, rather than topics or matters outside of the Department's jurisdiction such as general statements of project opposition or support, job creation, post-construction safety concerns or other matters not specifically pertaining to the modifications. Relevant remarks on these proposed permit modifications provided by commenters will be considered in the Department review process of the permit modification request.

 Individuals will have the opportunity to present up to 3 minutes of verbal testimony, this time limit is put in place to allow more commenters the opportunity to speak. To ensure that all speakers have a fair and equal opportunity to present their testimony, relinquishing of time to other speakers is not allowed, and groups are asked to designate one speaker per organization. The Department also requests, but does not require, those providing oral remarks bring a written copy of their comments in order to aid the transcriptionist at the hearing.

 Those who wish to present testimony during the scheduled hearing are asked to register in advance by contacting the Southeast Regional Office. Registration for the hearing will be taken through to the business day prior to the hearing. Priority will be given to residents from Chester County given the geographic scope of the modification applications.
