FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. No wetlands will be impacted by the project. The permit was issued on May 15, 2018.

E67-937: FedEX Ground Package System, Inc, 1000 FedEX Drive, Moon Township, PA 15108 in Fairview Township, York County, U.S. Army Corps of Engineers Baltimore District.

 To fill 0.13 of an acre of palustrine emergent (PEM) wetland to expand the existing parking area by 2.6 acres. The project is located south of Industrial Drive in Fairview Township, York County (Steelton, PA Quadrangle, Latitude: 40.1662 Longitude: -76.839581). Mitigation is required at a 1:1 ratio. No streams or floodways will be disturbed by this project. The permit was issued May 10, 2018.

E59-537. Pennsylvania Department of Transportation, Engineering District 3-0, PO Box 218 Montoursville, PA 17754-0218. S.R. 4017 Section 024, Losey Creek Bridge Replacement Chatham Twp., Tioga County, Baltimore ACOE (Elkland, PA Quadrangle N: 41° 53` 32"; W: -77° 21` 18").

 PA DOT Engineering District 3-0 proposes to replace a single span concrete encased steel I beam bridge with a single cell concrete box culvert. The existing bridge has a span of 16.7 Ft., a skew of 90 degrees, an underclearance of 10.8 Ft. and a low chord of 1,565.98 Ft. and a hydraulic opening of 179.8 Ft2. The proposed box culvert has a span of 19 Ft., a skew of 90 degrees, an underclearance of 7.5 Ft. and a low chord of 1,562.52 Ft. and a hydraulic opening of 142.5 Ft2. Both the existing and proposed structure will convey the 500 year storm without overtopping. The proposed structure will include culvert depression, baffles and native material throughout the structure in accordance with the BD-632M and PA Fish and Boat Commission recommendations. The project will utilize R-8 Rip Rap scour protection at the inlet and outlet. The project will temporarily impact 0.02 acre and permanently impact 0.01 acre of jurisdictional wetlands. The wetland impact is considered Deminimus and does not require mitigation. The project is beyond the 12 Ft threshold of GP-11. Losey Creek is classified as a Warm Water Fishery by Title 25, Chapter 93 Water Quality Standards. This permit also includes 401 Water Quality Certification

E03-472, Plenary Walsh Keystone Partners, Park West Two, Third Floor, 2000 Cliff Mine Road, Pittsburgh, PA 15275, Rural Valley Borough, Armstrong County, Pittsburgh ACOE District.

 Has been given consent to:

 1. Remove an existing 133` long by 31`-9" wide, three span, steel I-beam bridge over Cowanshannock Creek (WWF).

 2. Construct and maintain a replacement, 140` long by 35`-9" prestressed concrete, spread box beam bridge.

 3. Construct and maintain rock slope protection in the floodway on the upstream and downstream side of the aforementioned structure and associated improvements to the guiderails and approach roads.

 4. Relocate 116 linear feet of an existing unnamed tributary to Cowanshannock Creek (WWF) (aka Stream 2), and to construct and maintain a new, 140-foot long relocated channel.

 5. Permanently impact 57 linear feet of Cowanshannock Creek (WWF).

 6. Temporarily impact 101 linear feet of Cowansannock Creek with placement of cofferdams and a temporary stream crossing consisting of two temporary 84-inch pipes.

 7. Permanently place and maintain fill in 0.044 acre of PEM Wetland (Wetlands 1, 2 & 4).

 8. Permanently place and maintain fill in 0.013 acre of PSS Wetland (Wetland 3).

 9. Temporarily impact 0.284 acre of PEM Wetlands (Wetlands 1, 2 & 4) during construction, including a temporary crossing of Wetlands 1 and 2.

 10. Temporarily impact 0.01 acre of PSS Wetlands during construction. (Wetland 3).

 For the purpose of replacing the existing structurally deficient structure over Cowanshannock Creek (WWF). Mitigation will include restoring the temporarily disturbed wetlands with plantings and seeding. Temporarily disturbed PSS wetland will be restored with shrub and tree plantings. The permanent PEM and PSS wetland impacts will be mitigated at the PennDOT District 10-0 Armstrong County Wetland Bank with 0.064 acre of wetland credits. Stream mitigation will include the relocation of Stream 2 and plantings of trees and shrubs along the relocated channel. The project is located at State Route 2001, Segment P50, 0.1 mile from the intersection between State Route 2001 and State Route 0050, in Rural Valley, PA 16249. (Rural Valley USGS Topographic Quadrangle, Latitude: 40° 47` 49.9"; Longitude: -79° 18` 56.1; Sub-basin: 17E; Pittsburgh Corps District).

E63-706, Plenary Walsh Keystone Partners, Park West Two, Third Floor, 2000 Cliff Mine Road, Pittsburgh, PA 15275, North Strabane Township, Washington County, Pittsburgh ACOE District.

 Has been given consent to:

 Remove a single-span, steel I-beam structurally deficient bridge over Little Chartiers Creek (HQ-WWF) on SR 1023 in North Strabane Township, Washington County. The existing bridge consists of 5 W36X160 I-beams. The beams have pitting and rust on the lower webs and outer edges of the bottom flanges. The project will consist of the construction and maintenance of an 84-foot long, single span, prestressed concrete spread box beams bridge. The bridge will increase from 18.96 feet to 32.0 feet and will include two 11-foot lanes and 4-foot shoulders. Upgrades will include guiderail updates, drainage improvements, and overlaying of approaches. A temporary stream crossing with four, 48" temporary pipes will be constructed to allow construction access. The project will include the relocation of two unnamed tributaries to Little Chartiers Creek. Unnamed tributary (UNT-1) will have a total of 121 linear feet of permanent impact due to channel relocation and replacement of an existing 30" corrugated metal pipe (CMP) culvert. The existing 30" CMP is 21 feet long and will be replaced with a corrugated plastic 36" pipe that is approximately 22 feet in length. The pipe will be depressed six inches into the streambed. Unnamed tributary (UNT-2) will have a total of 83 linear feet of permanent impact due to the channel relocation. Also, 0.017 acre of wetlands will be permanently disturbed for the construction of the new bridge. Mitigation will not be required for this wetland impact since the impact is considered de minimus.

E65-961; Municipal Authority of Westmoreland County; 124 Park and Pool Road, New Stanton, PA 15672, Borough of Adamsburg, Hempfield Township, City of Jeanette; Westmoreland County; Pittsburgh ACOE District.

 Has been given consent to:

 Construct, operate, and maintain 5 (five) 48" waterline stream crossings including:

 1. One (1) crossing under Brush Creek (TSF) resulting in 20 linear feet of permanent impact;

 2. Four (4) crossings of unnamed tributaries (UNTs) to Brush Creek (TSF) resulting in 80 linear feet of impact.

 For the purpose of upgrading the Omnova to Adamsburg Tank Distribution Waterline. Approximately 15,000 linear feet of a 48" cast iron water line will be installed as part of this project. As a result of the project approximately 100 linear feet of stream will be impacted. Mitigation will include restoring the disturbed area back to its original condition and stabilizing the disturbed area. The project starts at the Adamsburg Tank, located near the intersection of Penn Adamsburg Road and Main Street (Irwin, PA Quadrangle; Latitude: 40° 18` 47"; Longitude: 79° 39` 3") and ends near the intersection of Chambers Avenue and Brown Avenue (Greensburg, PA Quadrangle; Latitude: 40° 19` 31"; Longitude: 79° 36` 47"). The project is located in Adamsburg Borough, Hempfield Township, and the City of Jeannette, Westmoreland County.

Northwest Region: Waterways & Wetlands Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481.

E10-504, Love's Travel Stops and Country Stores, 10601 North Pennsylvania Avenue, Oklahoma City, OK 73120. Love's Travel Stop—Slippery Rock PA in Worth Township, Butler County, ACOE Pittsburgh District (Harlansburg and Slippery Rock, PA Quadrangle N: 41°, 02`, 15"; W: 80°, 07`, 41").

 Construct and maintain the following impacts associated with construction of a convenience store, restaurant, tire shop, truck scale, fueling station, and associated roadways, parking, utilities, wastewater treatment plant, and stormwater management facilities at the intersection of I-79 and SR 108 (Harlansburg and Slippery Rock, PA Quadrangles N: 41°02`15"; W: 80°07`41") in Worth Township, Butler County:

 1. Permanent impact to 0.40 acre of wetland for the placement of fill.

 2. Permanent impact to 199 LF of a tributary to Slippery Rock Creek for the installation of a 157 ft long, 72-inch diameter, reinforced concrete stream enclosure with end walls, wingwalls, and rip rap apron.

 3. Permanent impact to 1.27 acre of floodway of tributaries to Slippery Rock Creek for the placement of fill.

 4. Permanent impact to 10 LF of Slippery Rock Creek and 690 ft2 of floodway of Slippery Rock Creek for the installation of a 6-inch PVC wastewater outfall with endwall and rip rap apron.

 The project includes mitigation for impacts by creating a minimum of 0.40 acre of new wetland on the southern portion of the site and by planting trees and shrubs in the wetland along a tributary to Slippery Rock Creek in the northern portion of the site.

E25-404C. Erie-Western Pennsylvania Port Authority, 1 Holland Street, Erie, PA 16507. Erie-Western Pennsylvania Port Authority Facility Maintenance Dredging in the City of Erie, Erie County. ACOE Pittsburgh District.

 This permit amends existing Water Obstruction and Encroachment Permit E25-404B authorizing the Erie-Western Pennsylvania Port Authority to perform maintenance dredging in and along Presque Isle Bay and Lake Erie in the City of Erie, Erie County in 19 management units as described in a Management Unit Inventory received by the Department on March 29, 2007. The Management Unit Inventory consists of a dredging table and Czop/Specter Inc. Drawing C-101 dated January 23, 2007. The permit provides options for the disposal of dredged material in the Erie Harbor Confined Disposal Facility, Lakeview Landfill, or for use as Clean Fill on Erie-Western Pennsylvania Port Authority properties. Periodic testing of dredged material is required to ensure that dredged material disposition complies with the Rules, Regulations, and Policies of the Department. Work under Water Obstruction and Encroachment Permit E25-404C is permitted through December 31, 2027. (Erie North, PA Quadrangle N: 42.131994°, -80.111374W°).

EROSION AND SEDIMENT CONTROL

Air Quality; Approval of a Reasonably Available Control Technology (RACT II) plan for Carpenter Company located in Upper Macungie Township, Lehigh County

 In accordance with 25 Pa. Code §§ 129.96—129.100, the Department of Environmental Protection (Department) has made a preliminary determination to approve a RACT II plan and an amendment to the State Implementation Plan (SIP) for their Expanded Polystyrene (EPS) & Polyurethane foam manufacturing processes at the facility located in Upper Macungie Township, Lehigh County.

 The proposed SIP revision does not adopt any new regulations. It incorporates the provisions and requirements contained in the amended RACT II approval for the facility, which are intended to satisfy the requirements for the 1997 National Ambient Air Quality Standard (NAAQS) and the 2008 NAAQS for ozone.

 The proposed amendments to the RACT II determination, if finally approved, will be incorporated into a revised operating permit (39-00040) for the facility. The relevant RACT II requirements will be submitted to the United States Environmental Protection Agency (EPA) as a revision to Pennsylvania's State Implementation Plan and will remain in effect until replaced pursuant to 40 CFR 51 and approval by the EPA. Requirements that are not part of the RACT II determination will be excluded from the SIP submittal.

 The following is a summary of the proposed amendments to the RACT II determination for this operation that will be submitted to the EPA as a SIP revision:

Request for comments on the Total Maximum Daily Load Developed for Halfmoon Creek, Centre County, PA

 The Department of Environmental Protection (Department) will accept comments as of May 26, 2018, for the proposed Total Maximum Daily Load (TMDL) developed to address aquatic life use impairments in Halfmoon Creek, as noted in 2016 Pennsylvania Integrated Water Quality Monitoring and Assessment Report (Integrated List), initially listed in 1998. Halfmoon Creek is a tributary of Spruce Creek and the greater Little Juniata River basin, Centre County. The watershed lies near Halfmoon and Ferguson Townships, Centre County. Biological impairments were originally noted during bioassessments in the watershed (NCRO, 2007). The source of degradation is related to agricultural activities, which effect the High Quality (HQ) attributes of Halfmoon Creek, most significantly in benthic inundation. The Commonwealth does not currently have water quality criteria for excess siltation, so a sediment TMDL endpoint was identified using a reference watershed approach. Based on a comparison to a similar watershed in land use, yet biologically nonimpaired HQ watershed, the maximum sediment loading should still allow water quality objectives to be met. Adjacent to the east, Beaver Branch, chosen for comparison and is also a tributary of Spruce Creek and the greater Little Juniata River, Centre County.

 This proposed TMDL sets allowable sediment loadings within the specifically impaired stream segments of the Halfmoon Creek watershed. The loading was allocated among the land uses of cropland, hay/pasture land, and associated stream banks present in the watershed. Data used in these TMDLs was generated using a watershed analysis model (Mapshed-E-GWLF) designed by the Penn State University. The following table shows the estimated components of the TMDL:

It is equal to the sum of modeled loading on forested land use, wetlands, open space and development. The adjusted load allocation (ALA) represents the remaining portion of the LA distributed among agricultural land and associated stream banks. The TMDL developed for the impaired stream segments within the Halfmoon Creek watershed to establish a reduction in the overall, sediment loading to 51.9% (56.6% for Cropland and 44.2% for Hay/Pasture and Stream Banks (equal % reduction, for example, the ALA divided by the summation of the baselines).  The Department of Environmental Protection (Department) will accept comments as of May 26, 2018, for the proposed Total Maximum Daily Load (TMDL) for sediment and total phosphorus (nutrients) developed to address impairments in the Markee Creek as noted in the 2016 Pennsylvania's Integrated Water Quality Monitoring and Assessment Report (Integrated List), initially listed in 2002. A separate TMDL was calculated for sediment and another for total phosphorus to address the nutrient impairment sources. Markee Creek is a tributary of East Licking Creek and the greater Juniata River, Juniata County. The impairments were documented during biological surveys of the aquatic life present in the watershed (1999 and 2004). Excessive siltation and nutrient loading from agriculture has been identified as the cause of these impairments to the Coldwater Fishery (CWF) aquatic life uses in Markee Creek. Because this Commonwealth does not currently have water quality criteria for excess siltation or nutrients, a TMDL endpoint for sediment and total phosphorus (nutrients) was identified using a reference watershed approach. Based on a comparison of a similar, unimpaired CWF, McKinley Run (tributary to Tuscarora Creek), the maximum sediment loading that should still allow water quality objectives to be met in the impaired segments of Markee Creek.

 The loading was allocated among the land uses of cropland, hay/pasture land, and associated stream banks present in the watershed. Data used in these TMDLs was generated using a watershed analysis model (Mapshed-E-GWLF) designed by the Penn State University. The TMDL developed for Markee Creek established a reduction in the current sediment loading to 49.4% and a 26.0% reduction in the current total phosphorus loading (or the equal % reduction, for example, the ALA divided by the summation of the baselines).  The Department of Environmental Protection (Department) will accept comments as of May 26, 2018, for the proposed Total Maximum Daily Load (TMDL) developed to address aquatic life use impairments in the Poplar Run watershed, as noted in Pennsylvania's 2016 Integrated Water Quality Monitoring and Assessment Report (Integrated List), initially listed 2002. The metals impairment, originating from Abandoned Mine Drainage (1996 and 2002), will not be addressed in this TMDL; metals reductions, related to AMD, are calculated through a different methodology. Poplar Run is a Coldwater Fishery (CWF) and a tributary of Indian Creek, the Youghiogheny River, and the greater Monongahela River Basin, Fayette County. The impairments were documented during biological surveys of the aquatic life present in the watershed (1998 and 2002). Excessive siltation has been identified as the cause of benthic habitat impairment. This nonpoint source pollution was described in the 1998 bioassessment as influenced by land developed namely, but this TMDL will address loading from other land uses such as agricultural activities within the watershed.

 Because this Commonwealth does not currently have water quality criteria for excessive siltation, a TMDL endpoint for sediment loading was identified using a reference watershed approach. Based on a comparison to similar, yet nonimpaired CWF watershed, such as Laurel Run (tributary to Indian Creek), the maximum sediment loading that should still allow water quality objectives to be met in the impaired segments of Poplar Run. Data used in these TMDLs was generated using a watershed analysis model (Mapshed-E-GWLF) designed by the Penn State University. The following table shows the estimated components of the TMDL:

Ross Run is a tributary of the Little Mahoning Creek and the larger Allegheny River Basin. The watershed is located in East, North, and South Mahoning Townships, Indiana County. The impairments were noted during bioassessments in the watershed (2005 and 2010) and excessive siltation due to grazing-related agriculture was identified as causing impairment to the designated aquatic life use of a High Quality—Cold Water Fish(ery), (HQ-CWF), in Ross Run. Because this Commonwealth does not currently have water quality criteria for sediment, a TMDL endpoint was identified using a reference watershed approach. Based on a comparison to the similar, nonimpaired watershed, the Mudlick Run, another HQ-CWF, was chosen for comparison and is a tributary to Little Mahoning Creek and the larger Mahoning Creek and Allegheny River basin, Indiana County, a 25.8% reduction in sediment loading will allow water quality to be met in the impaired Ross Run.

 The Department of Environmental Protection (Department) will accept comments as of May 26, 2018, for the proposed Total Maximum Daily Load (TMDL) developed to address aquatic life use impairments in the South Branch, South Fork of Pine Creek (SBSF Pine Creek), as noted in the 2016 Pennsylvania Integrated Water Quality Monitoring and Assessment Report (Integrated List), initially listed in 1998 Section 303(d) impaired streams list. A separate TMDL was calculated for sediment and another for total phosphorus to address the nutrient sources. The SBSF Pine Creek joins with the North Branch of South Fork Pine Creek to form South Fork Pine Creek. It is a tributary of the greater Pine Creek and the larger Allegheny River Basin. The watershed lies north of the town of Rural Valley, within Cowanshannock and Wayne Townships (USGS quadrangle—Rural Valley), mid-eastern Armstrong County.

 The impairments were originally noted during bioassessments in the watershed (SWRO, May 2008). Agricultural activities have been identified as the cause of biological impairment to the High Quality Cold Water Fishery (HQ-CWF) sustainment in the SBSF Pine Creek. Because this Commonwealth does not currently have water quality criteria for either sediment or total phosphorus (nutrient), a TMDL endpoint was identified using a reference watershed approach. Based on a comparison to a similar watershed in land use, yet biologically nonimpaired, the maximum sediment and total phosphorus loading should still allow water quality objectives to be met. Mudlick Run, another HQ-CWF, was chosen for comparison and is a tributary to Little Mahoning Creek and the larger Mahoning Creek and Allegheny River basin, Indiana County. This proposed TMDL sets allowable loadings within the specifically impaired stream segments of the SBSF Pine Creek watershed. The loading was allocated among the land uses of cropland, hay/pasture land, and associated stream banks present in the watershed. Data used in these TMDLs was generated using a watershed analysis model (Mapshed-E-GWLF) designed by the Penn State University. Components of the sediment TMDL and total phosphorus (nutrients) TMDL are summarized as follows:

 Load allocations were distributed to nonpoint sources, specifically all land use sources other than National Pollutant Discharge Elimination System (NPDES) permitted point source discharges with 10% of the TMDL reserved explicitly as a margin of safety (MOS). A search of the Department's online, GIS database, EMAP, identified no known point source discharges within the Poplar Run. Despite this, an additional allocation of 1% of the TMDL was incorporated into the WLA as a bulk reserve to take in account the dynamic nature of future permit activity. Loads not reduced (LNR) are the portion of the LA associated with nonpoint sources other than agricultural (croplands, hay/pasture), and associated stream banks. It is equal to the sum of modeled loading on forested land use, wetlands, and low development. The adjusted load allocation (ALA) represents the remaining portion of the LA distributed among agricultural land and associated stream banks. The TMDL developed for the impaired SBSF Pine Creek established a reduction in the overall, sediment loading to 59.3% and a 29.4% reduction in the total phosphorus loading (or the equal % reduction, for example, the ALA divided by the summation of the baselines). The data and all supporting documentation used to develop the proposed TMDLs are available from the Department.
