FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704.  To place 915 SF of impervious parking and 19,356 SF of pervious bioretention basin and lawn area within the floodplain of Pennypack Creek (WWF/MF) associated with the removal and reconstruction of existing parking lot.

 The site is located along State Road and west of Pennypack Creek (USGS Frankford, PA Quadrangle Latitude 40.03222; Longitude -75.01833).

 The issuance of this permit also constitutes approval of a Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

E15-890. Pennsylvania Department of Transportation Engineering District 6-0, 7000 Geerdes Blvd., King of Prussia, East Bradford and West Bradford Townships, Chester County, ACOE Philadelphia District.

 To perform to remove an existing bridge and to construct and maintain the following activities as detailed below for SR 322, Section CDB (Downingtown Pike). Compensatory mitigation for loss of wetland and stream is associated with this project.

 1) To construct and maintain a 159-foot two-span, single pier, pre-stressed concrete bulb-T beam bridge over East Branch Brandywine Creek (Channel 1) resulting in 285 feet (9,375 square feet) of permanent impact. This activity includes the placement of scour protection for pier and abutments.

 2) To remove existing bridge and abutments to facilitate positive stormwater drainage to East Branch Brandywine Creek (Channel 1) resulting in 1,935 square feet of permanent impact. This work also includes the construction of a drainage swale and the permanent placement of rock apron upstream of the removed left abutment.

 3) To construct two (2) temporary causeways to facilitate the removal of the existing pier and construction of the new pier at the new bridge location.

 4) To construct two (2) drainage swales with rock aprons in association with the realignment of left and right roadway approaches upstream of proposed bridge over East Branch Brandywine Creek (Channel 1) (WWF/MF) resulting in 687 square feet of permanent impact.

 5) To relocate an unnamed tributary to East Branch Brandywine Creek (Channel 3) (WWF/MF) and place fill within wetland (Wetland B) (PEM/PSS) in association with the realignment of right roadway approach resulting in 472 linear feet (3,867 square feet) of permanent stream impact and 511 square feet (0.012 acre) of permanent wetland impact.

 6) To permanently place a rock apron at the outfall of an existing 18-inch RCP culvert and grade channel (Channel 3A) to facilitate positive stormwater drainage to relocated unnamed tributary to East Branch Brandywine Creek (Channel 3).

 7) To extend a 42-inch RCP culvert and place fill within an unnamed tributary to East Branch Brandywine Creek (Channel 2) (WWF/MF) and wetland (Wetland C) (PEM/PSS) associated with the realignment of left roadway approach resulting in 71 feet (497 square feet) of permanent stream impact and 8,795 square feet (0.202 acre) of permanent wetland impact.

 8) To permanently place fill, grade, construct a rock-lined channel and install compacted impervious material within the 100-year floodway of the East Branch Brandywine Creek (Channel 1) (WWF/MF) to facilitate the construction of a wetland mitigation site resulting in 441 linear feet (13,509 square feet) of permanent stream impact.

 The project will have a total permanent watercourse impact of 719 linear feet (12,072 square feet) with 403 linear feet (21,104 square feet) of temporary watercourse impact. A total permanent floodway impact of 38,266 square feet (0.878 acre) with 87,578 square feet (2.011 acres) of temporary floodway impact is proposed. A total permanent wetland impact of 9,306 square feet (0.214 acre) with 4,548 square feet (0.104 acre) of temporary wetland impact is proposed.

 The applicant is proposing to create 0.263 acre of wetland and restore 420 linear feet of watercourse. Project limits extend from SR 322 intersection with Sugars Bridge Road east to the SR 322 intersection with Skelp Level Road in West Bradford and East Bradford Townships, Chester County (USGS PA Unionville Quadrangle—Latitude: 39.968438 N, Longitude: 75.672495 W).

 The issuance of this permit also constitutes approval of a Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

 Department authorization giving consent to (1) modify, operate, and maintain an existing road, (2) install, operate and maintain a service utility line encasement, and (3) install, operate and maintain a natural gas service pipeline all crossing Elevenmile Creek for private residential use. The existing private road crossing Elevenmile Creek shall be modified by removing an existing 36-inch diameter corrugated metal pipe and installing an arch corrugated metal pipe having a minimum span of 95-inches, rise of 67-inches, length of 22-feet and a 1-foot culvert inlet invert depression. A maximum 10-feet of service utility line encasement crossing Elevenmile Creek shall be installed, so that the top of encasement is a minimum 3-feet beneath existing streambed elevation. A maximum 10-feet of natural gas service pipeline crossing Elevenmile Creek shall be installed, so that the top-of-pipe or concrete encasement is 3-feet beneath existing streambed elevation. The arch corrugated metal pipe, utility service encasement, and natural gas service pipeline shall be installed by diverting stream flow around work areas with flumes, dam and pump, cofferdams or boring. The project is located along the northern right-of-way of SR 4023 approximately 2,135-feet east of T-380 (Healey Road) and SR 4023 intersection District in Oswayo Township, Potter County.

 Remove the existing 21` wide SR 3073 bridge over a UNT to Buffalo Run (WWF) with a minimum underclearance of 3.1` and a drainage area of 0.24 square miles; construct and maintain a 61` long 12` wide box culvert with a minimum underclearance of 4` in the same location. Place and maintain fill in 165` of UNT to Buffalo Run and construct and maintain 165` of relocated replacement channel. In addition, place and maintain fill in 0.01 acre of PEM wetland and temporarily impact 240` of UNT to Buffalo Run and 0.02 acre of PEM wetland for the purpose of constructing these encroachments. Mitigation will occur onsite via construction methods. The project is located 0.5 mile south of the intersection of SR 3073 Buttermore Road and SR 31 Mount Pleasant Road (USGS Mount Pleasant, PA Quadrangle, Latitude: 40° 10` 5.7"; Longitude: -79° 36` 56.9").
