FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483.  To amend, construct, repair and maintain the existing Schuylkill River Trail Project Joint Permit Application extending 9.62 Miles from Township Line Road (East Pikeland Twp.) and running Parallel to the Schuylkill River to a terminus at the SR 422 Bridge over the Schuylkill River. The new Trail construction (Section 2, 3, 4 and 5) will include the construction of 14-foot-wide, 3.86 miles long paved trail in and along the 100 year floodplain of the Schuylkill River located on the existing railroad bed, existing canal towpath, Towpath Path Park, and private property; a new 24 ft. by 14 ft. by 7 ft. precast concrete arch bridge and 5 additional minor stream crossings of unnamed tributaries to the Schuylkill River, impacting 1.4 Acre of the floodway and 4.0 Acres of the floodplain. No net fill is proposed for this project.

 This Project is for Phase II, which extends from Linfield Road to SR 422, located in East and North Coventry Townships (Phoenixville, PA USGS Quadrangle, Latitude: 40.174889; Longitude: -77.542311).

 The issuance of this permit also constitutes approval of a Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

E15-898: East Goshen Township, 1580 Paoli Pike, West Chester, PA 19380-6199, East Goshen Township, Chester County, ACOE Philadelphia District.

 To construct and maintain approximately 6,750 feet-long shared use pedestrian path along the Paoli Pike partially within the floodway/floodplain of the Unnamed Tributary (UNT) to Ridley Creek (HQ—TSF, MF) associated with the Paoli Pike Shared Use Path Project. The pedestrian path will also cross over the UNT to Ridley Creek on the existing Paoli Pike Bridge.

 The site is located around the existing Paoli Pike Bridge (USGS West Chester, PA Quadrangle Latitude 39.992470; Longitude -75.547408).

 The issuance of this permit also constitutes approval of a Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

E23-536. Newtown Township Delaware County Municipal Authority (NTMA), 209 Bishop Hollow Road, Newtown Square, PA 19073-3219, Newtown Township, Delaware County, ACOE Philadelphia District.

 The site is located near Echo Valley Lane and extends through South of Goshen Road (Valley Forge and Media USGS Map; Latitude: 39.992081; Longitude: -75.43954).

 To construct, regrade, and maintain approximately 805 LF of an existing drainage channel in and along the unnamed tributary of Chester Creek (WWF) impacting approximately 0.028 acre of wetland. Work will include the rehabilitation and the construction of series of pools connected by short pipe runs and constructing a culvert from the discharge point of the pool system. The site is located near the intersection of Concord Road and Sunfield Drive (Marcus Hook, PA, USGS Quadrangle Map, Latitude: 39.852270; Longitude: -75.400227).

 The issuance of this permit also constitutes approval of a Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

 To install and maintain approximately 13.2-mile-long, 12-inch pipeline and appurtenant structures. The project impacts in Berks County include a total of 1,051 linear feet of permanent impacts to the Schuylkill River (WWF, MF), three (3) Unnamed Tributaries to the Schuylkill River (WWF, MF), nineteen (19) Unnamed Tributaries to Monocacy Creek (WWF, MF), two (2) crossings of Monocacy Creek (WWF, MF), four (4) Unnamed Tributaries to Manatawny Creek (CWF, MF), Little Manatawny Creek (CWF, MF), and an Unnamed Tributary to Little Manatawny Creek (CWF, MF), and 2.07 acres of floodway impacts, and temporarily impact 0.62 acre of floodway; 2.39 acres of permanent impacts to PEM, PFO, and PSS wetland(s), and temporarily impact 0.1 acre of EV PEM wetland. 1.07 acre of PFO and PSS wetland conversion to PSS and PEM is proposed in Berks County which will be offset by plantings and enhancement of 3.72 acres of EV PEM wetland adjacent to Bieber Creek in Oley and Pike Townships, Berks County to mitigate for the conversion of PSS and PFO wetlands. The proposed project impacts in this permit application are associated with a proposed transmission pipeline project extending approximately 13.2 miles in Pennsylvania between Birdsboro Borough, Berks County, PA and Rockland Township, Berks County, PA. The permit was issued on October 30, 2018.

E41-695 McIntyre Township Supervisors, 47 Thompson Street, Ralston, PA 17763. T-665 Pleasant Stream Road, Pleasant Stream Bridge Replacement, McIntyre Township, Lycoming County, Baltimore ACOE (Bodines, PA Quadrangle N: 41° 29` 16"; W: -76° 56` 26").

 McIntyre Township Supervisors propose to replace a Single Span Steel I-Beam Bridge with a Single Span Pre-Stressed Concrete Spread Box Beam Bridge, which will be located approximately 55 Ft. downstream of the existing structure. The existing bridge has a span of 39.7 Ft., a skew of 80 degrees, an underclearance of 8.0 Ft., and a low chord of 937.52 Ft. and a hydraulic opening of 338 Ft2. The proposed bridge has a span of 49.6 Ft., a skew of 60 degrees, an underclearance of 7.61 Ft., and a low chord of 935.78 Ft. and a hydraulic opening of 348 Ft2. The proposed structure will utilize Grouted R-8 Rip Rap, choked with R-4 Rip Rap scour protection around the abutments and wing walls. The area disturbed from removing the existing structure and the stream banks between the existing and proposed structure will be stabilized with grouted R-8 Rip Rap, choked with R-4 Rip Rap. The existing structure will be utilized to convey traffic during construction. The project will not impact any jurisdictional wetlands. Pleasant Stream is classified as an Exceptional Value Stream by Title 25, Chapter 93 Water Quality Standards and a Stocked and Wild Trout Stream by PA Fish and Boat Commission. The project will not require mitigation. This permit also includes 401 Water Quality Certification.
