COAL AND NONCOAL MINING
ACTIVITY APPLICATIONS

 Applications under the Surface Mining Conservation and Reclamation Act (52 P.S. §§ 1396.1—1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P.S. §§ 3301—3326); The Clean Streams Law (35 P.S. §§ 691.1—691.1001); the Coal Refuse Disposal Control Act (52 P.S. §§ 30.51—30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P.S. §§ 1406.1—1406.20a). Mining activity permits issued in response to such applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P.S. §§ 4001—4015); the Dam Safety and Encroachments Act (32 P.S. §§ 693.1—693.27); and the Solid Waste Management Act (35 P.S. §§ 6018.101—6018.1003).

 The following permit applications to conduct mining activities have been received by the Department. A copy of the application is available for inspection at the district mining office indicated before each application. Notices of requests for 401 Water Quality Certifications are included in individual application notices, as noted.

 Written comments or objections, or requests for an informal conference, or a public hearing, as applicable, on a mining permit application and request for Section 401 water quality certification application may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the address of the district mining office indicated before each application within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement as provided by 25 Pa. Code §§ 77.121—77.123 and 86.31—86.34.

 Written comments or objections regarding a mining permit application should contain the name, address and telephone number of persons submitting comments or objections, application number and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based.

 A request for an informal conference or a public hearing, as applicable, on a mining permit application, as provided by 25 Pa. Code § 77.123 or § 86.34, must contain the name, address and telephone number of the requestor; the application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

 When an NPDES number is listed, the mining activity permit application was accompanied by an application for an individual NPDES permit. A separate notice will be provided after the draft NPDES permit is prepared.

MINING ACTIVITY NPDES DRAFT PERMITS

 This notice provides information about applications for a new, amended or renewed NPDES permits associated with mining activity (coal or noncoal) permits. The applications concern industrial waste (mining) discharges to surface water and discharges of stormwater associated with mining activities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 The Department of Environmental Protection (Department) has prepared a draft NPDES permit and made a tentative determination to issue the NPDES permit in conjunction with the associated mining activity permit.

Effluent Limits for Coal Mining Activities

 For coal mining activities, NPDES permits, when issued, will contain effluent limits that are the more stringent of technology-based (BAT) effluent limitations or Water Quality Based Effluent Limits (WQBEL).

 The BAT limits for coal mining activities, as provided in 40 CFR Part 434 and 25 Pa. Code Chapters 87—90 are as follows:

 A settleable solids instantaneous maximum limit of 0.5 ml/l applies to: surface runoff (resulting from a precipitation event of less than or equal to a 10-year 24-hour event) from active mining areas; active areas disturbed by coal refuse disposal activities; mined areas backfilled and revegetated; and all other discharges and drainage (resulting from a precipitation event of greater than 1-year 24-hour to less than or equal to a 10-year 24-hour event) from coal refuse disposal piles. Similarly, modified BAT limits apply to iron, manganese and suspended solids in surface runoff, discharges and drainage resulting from these precipitation events and those of greater magnitude in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

 Exceptions to BAT effluent limits may be applicable in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

Effluent Limits for Noncoal Mining Activities

 The limits for noncoal mining activities as provided in 25 Pa. Code Chapter 77 are pH 6 to 9 and other parameters the Department may require.

 Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional water quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description specifies the parameters.

 In addition to BAT or WQBEL limits, coal and noncoal NPDES permits establish effluent limitations in the form of implemented Best Management Practices (BMPs) identified in the associated Erosion and Sedimentation Plan, the Reclamation Plan and the NPDES permit application. These BMPs restrict the rates and quantities of associated pollutants from being discharged into surface waters in this Commonwealth.

 More restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining that may occur are incorporated into an NPDES permit when necessary for compliance with water quality standards and antidegradation requirements (in accordance with 25 Pa. Code Chapters 91—96).

 The procedures for determining the final effluent limits, using a mass-balance equation or model, are found in Technical Guidance Document 563-2112-115, Developing National Pollutant Discharge Elimination System (NPDES) Permits for Mining Activities. Other specific factors to be considered include public comments and Total Maximum Daily Load(s). Additional discharge limitations may apply in the event that unexpected discharges occur.

 Discharge rates for surface mining activities are precipitation driven. Discharge rates for proposed discharges associated with underground mining are noted in the permit description.

 Persons wishing to comment on an NPDES draft permit should submit a written statement to the Department at the address of the district mining office indicated before each draft permit within 30 days of this public notice. Comments received within the comment period will be considered in the final determinations regarding the NPDES permit applications. Comments must include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.

 The Department will also accept requests or petitions for a public hearing on NPDES permit applications, as provided in 25 Pa. Code § 92a.82(d). The request or petition for a public hearing shall be filed within 30 days of this public notice and contain the name, address, telephone number and the interest of the party filing the request, and state the reasons why a hearing is warranted. A public hearing may be held if the Department considers the public interest significant. If a hearing is scheduled, a notice of the hearing on the NPDES permit application will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. When a public hearing is held, the Department will consider comments from the public hearing in the final determination on the NPDES permit application.

Coal NPDES Draft Permits

NPDES No. PA0248894 (Mining Permit No. 4072SM22), Penn Coal Land, Inc., P.O. FEDERAL WATER POLLUTION
CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

E51-295: Philadelphia Water Department (PWD), 1101 Market Street, Philadelphia, ACOE Philadelphia District.

 Philadelphia Water Department is proposing to remove an existing outfall and, in its place, construct and maintain a larger 48-inch by 76-inch concrete outfall resulting in 92 linear feet (2,881 square feet) of temporary stream impacts, 75 linear feet (6,630 square feet) of permanent stream impact, 91 linear feet (1,223 square feet) of temporary floodway impact and 44 linear feet (409 square feet) of permanent floodway impact within the Delaware River (WWF-MF). This activity also includes construction of temporary coffer dam and the permanent placement of riprap rock apron and concrete end wall. This project is located at the end of Levick Street at the Delaware River and is associated with the SR 0095, Section BS1 Project in Philadelphia. (USGS PA Frankford Quadrangle—Latitude 40.015885, Longitude 75.052429 W).

 To construct and maintain the following water obstructions and encroachments associated with the Gordon Street Bridge replacement:

 1. To remove an existing bridge structure and to construct and maintain a 56.7-foot long, 112-foot span composite prestressed concrete PA Bulb-Tee bridge crossing of Jordan Creek (TSF, MF) having a 9.1-foot underclearance, and R-8 riprap placed adjacent to each abutment.

 2. To remove and relocate an existing stormwater outfall along the western bank of Jordan Creek (TSF, MF) consisting of approximately 150-LF of two (2) 60-inch diameter reinforced concrete pipes, concrete endwall, and R-8 riprap apron.

 3. To remove and relocate an existing sanitary sewer line within the floodway of Jordan Creek (TSF, MF) consisting of a 24-inch diameter pipe and two (2) concrete manholes.

 4. To remove and relocate an existing stormwater outfall along the eastern bank to Jordan Creek (TSF, MF) consisting of approximately 65-LF of a 54-inch diameter reinforced concrete pipe, concrete endwall, and R-8 riprap apron.

 5. To remove and relocate an existing water line crossing of Jordan Creek (TSF, MF) consisting of approximately 100-LF of 8-inch diameter ductile iron pipe.

 The project is located approximately 0.3 mile east of the intersection of North 5th Street and West Gordon Street (Allentown East, PA Quadrangle Latitude: 40° 36` 37"; Longitude: -75° 27` 55") in Allentown City, Lehigh County. (Allentown East, PA Quadrangle, Latitude: 40° 36` 37"; Longitude: -75° 27` 55").

E5402219-003. Pine Grove Township, 175 Oak Grove Road, Pine Grove, PA 17963, in Pine Grove Township, Schuylkill County, U.S. Army Corps of Engineers, Baltimore District.

 To construct and maintain the following water obstructions and encroachments associated with the Swopes Valley Road (T-649) Bridge Replacement over Swope Valley Run (CWF, MF).

 1) To remove an existing bridge structure and to construct and maintain a 58.0-foot long, 28.0-foot span single cell precast open-bottom arch culvert crossing of Swope Valley Run (CWF, MF) having a 7.0-foot underclearance to the normal flow elevation, R-8 riprap, and precast concrete upstream and downstream wingwalls. This crossing will permanently impact 0.01 acre of PEM Wetlands (EV).

 2) To re-establish an existing stormwater outfall along the western bank to Swopes Valley Run (CWF, MF) consisting of approximately 225-LF of an 18-inch diameter pipe and a riprap apron.

 The project is located at the intersection of Swopes Valley Road (T-649) and SR 645 (Geary Wolfe Road) (Pine Grove & Swatara Hill, PA Quadrangle Latitude: 40° 31` 26.0" Longitude: -76° 23` 10.0") in Pine Grove Township, Schuylkill County.

E1006219-001, Forest Edge LP, P.O. Box 97, Mars, PA 16046. Forest Edge PDG Phase III, in Cranberry Township, Butler County, ACOE Pittsburgh District (Mars, PA Quadrangle N: 40° 42` 26"; W: 80° 3` 4").

 The applicant proposes to construct phase III of a residential development associated roadways, utilities, and stormwater management facilities. The project will permanently impact a total of 0.20 acre of PEM/PSS wetlands and temporarily impact 20 linear feet of a UNT to Kaufman Run (WWF) for a temporary road crossing. The applicant proposes to mitigate for wetland impacts by purchasing credits in the Robinson Fork Mitigation Bank.

District Oil & Gas Operations: Eastern Oil & Gas District, 208 West Third Street, Suite 101, Williamsport, PA 17701.

E5829-144: Rush Township, Repsol Oil & Gas USA, 337 Daniel Zenker Drive, Horseheads, NY 14845; Rush Township, Susquehanna County, ACOE Baltimore District.

 To construct, operate, and maintain:

 1) a permanent access road utilizing a 48-inch HDPE × 42 lineal feet culvert permanently impacting 48 lineal feet of an unnamed tributary to North Branch Wyalusing Creek (CWF, MF) (Lawton, PA Quadrangle; Latitude: 41° 48` 39", Longitude: -76° 07` 06");

 2) a temporary timber bridge stream crossing and a wetland mitigation area impacting 16 lineal feet of an unnamed tributary to North Branch Wyalusing Creek (CWF, MF) (Lawton, PA Quadrangle; Latitude: 41° 48` 40", Longitude: -76° 07` 08");

 3) a permanent access road crossing impacting 6,435 square feet (0.15 acre) of a palustrine emergent wetland (PEM) (Lawton, PA Quadrangle; Latitude: 41° 48` 39", Longitude: -76° 07` 07");

 4) a permanent access road crossing utilizing three 12-inch diameter culverts impacting 10,835 square feet (0.25 acre) of a palustrine emergent wetland (PEM) (Lawton, PA Quadrangle; Latitude: 41° 48` 40", Longitude: -76° 07` 05");

 5) three culvert discharge aprons impacting 88 square feet (0.01 acre) of a palustrine emergent wetland (PEM) (Lawton, PA Quadrangle; Latitude: 41° 48` 40", Longitude: -76° 07` 05");

 6) a permanent access road crossing impacting 1,466 square feet (0.03 acre) of a palustrine emergent wetland (PEM) (Lawton, PA Quadrangle; Latitude: 41° 48` 42", Longitude: -76° 07` 01").

 The Warner W. (05-121) Well Site project consists of remediating unpermitted third party impacts to multiple resources and utilizing previously impacted areas for construction of a well pad access road located in Rush Township, Susquehanna County. The project will result in 64 lineal feet of stream impacts and 18,824 square feet (0.43 acre) of palustrine emergent (PEM) wetland impacts to resources previously impacted by the landowner to provide permanent access for development of Marcellus Shale natural gas formations. The project is providing 8,150 square feet (0.19 acre) of wetland mitigation for permanent impacts; and, will additionally remediate third party impacts totaling 93,741 square feet (2.15 acres) of stream floodway impacts and 58,435 square feet (1.34 acre) of palustrine emergent wetlands (PEM).

E08-505. Wyalusing Borough, 50 Senate Street, P.O. Box 131, Wyalusing, PA 18853, Wyalusing Township, Bradford County, U.S. Army Corps of Engineers, Baltimore District. Wyalusing Borough has applied for a joint permit in order to install a new pipe culvert in Brewer Creek to allow access to Borough land. Presently, the crossing of this creek exists as a ford crossing in another location. The proposed culvert will be installed as a low-flow stream crossing, allowing higher streamflow to pass over the top of the roadway to limit any impacts on the 100-year floodplain. The crossing is in the same location as a previously permitted temporary crossing installed (via GP-8) during oil and gas activities on the same lands. The temporary crossing has been removed, but a gas pipeline right-of-way exists across Brewer Creek.

 PA DOT proposes to Rehabilitate a Single Lane, Single Span Steel Suspension Bridge. The existing bridge has a span of 295.5 Ft., a skew of 90 degrees, an underclearance of 14.4 Ft., and a low chord of 881.45 Ft. and a hydraulic opening of 3,407 Ft2. The proposed rehabilitated structure has a span of 295.5 Ft., a skew of 90 degrees, an underclearance of 14.8 Ft., and a low chord of 881.80 Ft. and a hydraulic opening of 3,501 Ft2. The existing historic structure rehabilitation includes substructure replacement and superstructure rehabilitation. Coordination on the historic structure includes a no effect finding. A temporary two span bridge will be constructed approximately 135 L.F. downstream and will remain in place for the duration of the three construction seasons expected to complete the project. The project will include two proposed outfalls to the receiving stream. The project will temporarily and permanently impact 0.01 acre of jurisdictional wetlands. Little Pine Creek and Tributaries are classified as an Exceptional Value Stream by 25 Pa. Code Chapter 93 Water Quality Standards and a Stocked and Wild Trout Stream by PA Fish and Boat Commission.

 PA DOT proposes to replace a Single Lane, Single Span Concrete Encased Steel I-Beam Bridge with a Single Span Pre-Cast Concrete Box Culvert. The existing bridge has a span of 14 Ft., a skew of 61 degrees, an underclearance of 7.0 Ft., and a low chord of 959.91 Ft. and a hydraulic opening of 126 Ft2. The proposed box culvert has a span of 18 Ft., a skew of 60 degrees, an underclearance of 7.5 Ft., and a low chord of 958.57 Ft. and a hydraulic opening of 135 Ft2. The proposed structure will utilize R-8 Rip Rap, choked with native streambed material as scour protection at the inlet and outlet. The proposed structure is beyond the thresholds to meet GP-11. A detour will be utilized to convey traffic during construction. The project will not impact any jurisdictional wetlands. Cold Brook is classified as a Cold Water Fishery by 25 Pa. Code Chapter 93 Water Quality Standards.

The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P.S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984.
