FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval, and requests for Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with the applicable provisions of Sections 301—303, 306 and 307 of the FWPCA 33 (U.S.C.A. §§ 1311—1313, 1316 and 1317, and that the construction will not violate applicable Federal and State Water Quality Standards.

 Any person aggrieved by these actions may appeal, pursuant to Section 4 of the Environmental Hearing Board Act, 35 P.S. Section 7514, and the Administrative Agency Law, 2 Pa.C.S.  2. An access road crossing of a UNT to Collins Creek (CWF, MF) that will also permanently impact 0.18 acre of adjacent EV wetlands. The crossing consists of a 70-foot long, 72-inch diameter RCP culvert with upstream wingwalls, downstream wingwalls and riprap.

 Wetland mitigation equal to approximately 0.27 acre is proposed on-site. While traveling north on Commerce Road, turn right onto Sathers Drive. The project access is located approximately 0.1-mile down Sathers Drive on the right (Avoca, PA Quadrangle Latitude: 41° 18` 51.0"; Longitude: -75° 44` 0.0") in Pittston Township and Dupont Borough, Luzerne County.

 To remove existing structure and to (1) install and maintain a 96 foot × 28 foot bridge over Pequea Creek (WWF, MF) with R-8 Riprap scour protection and (2) construct road realignment in the floodway of Pequea Creek (WWF, MF) along Pequea Valley Road for the purpose of improving transportation safety in Leacock and Paradise Townships, Lancaster County (40.0179°; -76.0698°). The project proposes to permanently impact 93 linear feet of stream channel and 173 linear feet of stream channel as temporary impacts. Permit issued March 17, 2021.

 Construct and maintain a 40 ft by 13 ft prefabricated bridge on concrete strip footings. The bridge will connect a snowmobile trail over Losey Run (HQ-CWF, Wild Trout), HUC 12 Code: 020502050202, tributary to Pine Creek (HQ-CWF, Class A Trout). The bridge will lessen the impact to Losey Run by trail users. The proposed structure will be located in Ulysses Township, Potter County and within the Susquehannock State Forest. Installation is planned for the Spring of 2021.

Authorized work at Main Pumping Station site: 2,550.00 square feet of at grade paving, a 24 ft by 13 ft by 6 inch concrete generator pad, 24 ft by 13 feet by 6 ft chain link fence, posts and doorways, and installation of a diesel generator and associated fuel tank and hardware installed on the generator pad. Authorized work at the Shamokin Dam Pump Station site: removal of chain link safety fencing along the north, south and east sides of the building, installation of a 6 ft high flood wall on the north, south and east sides of the building, and an elevated generator pad and diesel generator with a top of slab elevation of 447.12 ft. The pad will be set upon 6 columns and allow for flow through the structure. The pad will be surrounded by a 25 ft by 20 ft by 6 ft chain link fence, posts and doorways.  DTE Appalachia Gathering, LLC is proposing to remediate a slope failure near Station 523+00 of the Appalachia Pipeline Project South. The project requires permanent impacts to wetlands due to subsurface drains and reconstruction of the slope. The permanent loss of the wetland (0.08 acre) will be mitigated for by credits purchased from an approved mitigation bank.

PREAMBLE 2


The Following Plans and Reports Were Submitted Under the Storage Tank and Spill Prevention Act (35 P.S. §§ 6021.101—6021.2104).

 Provisions of 25 Pa. Code Chapter 245, Subchapter D, Administration of the Storage Tank and Spill Prevention Program, require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A remedial action plan is submitted to summarize the site characterization, document the design and construction details for the remedial action, and describe how the remedial action will attain the selected remediation standard. The remedial action plan also provides results of studies performed and data collected to support the remedial action and a description of postremediation care requirements. A remedial action completion report is submitted to document cleanup of a release of a regulated substance at a site to the selected remediation standard. A remedial action completion report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

The Department of Environmental Protection (DEP) Has Taken Action on the Following Plans And Reports Under the Storage Tank And Spill Prevention Act (35 P.S. §§ 6021.101—6021.2104).

 Provisions of 25 Pa. Code Chapter 245, Subchapter D, Administration of the Storage Tank and Spill Prevention Program, require DEP to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports.

 A remedial action plan is submitted to summarize the site characterization, document the design and construction details for the remedial action, and describe how the remedial action will attain the selected remediation standard. The remedial action plan also provides results of studies performed and data collected to support the remedial action and a description of postremediation care requirements. A remedial action completion report is submitted to document cleanup of a release of a regulated substance at a site to the selected remediation standard. A remedial action completion report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

 DEP may approve or disapprove plans and reports submitted. This notice provides DEP's decision and, if relevant, the basis for disapproval.

Box 19029, Houston, TX 77224, submitted a Remedial Action Plan concerning remediation of soil and groundwater contaminated with PC99, which contains 99% para-cresol (4-methylphenol) with 1% meta-cresol (2-methylphenol). The Remedial Action Plan was acceptable to meet the Statewide health standard and was approved by DEP on March 30, 2021.

Ashland Bulk Plant 714, Storage Tank Facility ID #2 0-01807, 1500 Water Street, Conneautville, PA 16406, Conneautville Borough, Crawford County. Antea Group, 10400 Blacklick Eastern Road, Suite 130, Pickerington, OH 43147, on behalf of Ashland, LLC, 500 Hercules Road, Wilmington, DE 19808 submitted a Remedial Action Completion Report concerning remediation of soil and groundwater contaminated with benzene, toluene, ethylbenzene, xylenes, methyl tert-butyl ether, cumene, naphthalene, benzo(a)anthracene, benzo(a)pyrene, benzo(b)fluoranthene, benzo(g,h,i)perylene, phenanthrene, fluorene, and lead. The Remedial Action Completion Report demonstrated attainment of the Site-Specific Standard and was approved by DEP on April 1, 2021.

Penelec Oil City, Storage Tank Facility ID # 61-18226, 1600 West First Street, Oil City, PA 16301, City of Oil City, Venango County. P. Joseph Lehman, Inc., P.O. Box 419, Hollidaysburg, PA 16648, on behalf of FirstEnergy—Pennsylvania Electric Company, 800 Cabin Hill Drive, Greensburg, PA 15601 submitted a Remedial Action Completion Report concerning remediation of soil contaminated with petroleum constituents (diesel fuel). The Remedial Action Completion Report demonstrated attainment of the Statewide health standard and was approved by DEP on April 1, 2021.

Joy Cone Manufacturing, Storage Tank Facility ID # 43-16530, 3435 Lamor Road, Hermitage, PA 16148, City of Hermitage, Mercer County. Compliance Environmental Services, Inc., P.O. Box 186, West Middlesex, PA 16159, on behalf of Joy Cone Company, 3435 Lamor Road, Hermitage, PA 16148 submitted a Remedial Action Completion Report concerning remediation of soil and groundwater contaminated with petroleum constituents (unleaded gasoline). The Remedial Action Completion Report demonstrated attainment of the Statewide health standard and was approved by DEP on April 1, 2021.
