FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval, and requests for Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with the applicable provisions of Sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317), and that the construction will not violate applicable Federal and State Water Quality Standards.

 Any person aggrieved by these actions may appeal, pursuant to Section 4 of the Environmental Hearing Board Act, 35 P.S. § 7514, and the Administrative Agency Law, 2 Pa.C.S.  For the purpose of facilitating future commercial pads and a staging area for commercial trucking operations. The project will permanently impact 214 linear feet of stream, 0.22 acre of wetland and 1.42 acres of floodway. The project will temporarily impact 21 linear feet of stream, 0.003 acre of wetland and 0.02 acre of floodway. Mitigation for these proposed impacts will occur on-site and are included in a comprehensive mitigation plan that will also include restoration of wetlands and streams that were previously impacted without a permit in accordance with a Consent Order and Agreement (COA), dated December 3, 2010. The project site is located on Baker Drive off Route 21 East (Waynesburg, PA USGS topographic quadrangle; N: 39°, 54`, 8.5"; W: -80°, 8`, 33"; Sub-basin 19B; USACE Pittsburgh District), in Franklin Township, Greene County.

EA2506221-001, US Army Corps of Engineers (Buffalo District), 1776 Niagara Street, Buffalo, NY 14207, 2021 Erie Harbor Dredging, Erie County (Erie North, PA Quadrangle 42° 12` 27.8"N; 80° 03` 29.4"W).

 The US Army Corps of Engineers is granted Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)) to dredge approximately 400,000 cubic yards of sediment from the Erie Harbor Federal navigation channels and dispose of the dredged material at an existing, authorized one-mile square open-lake discharge area in Lake Erie within Pennsylvania waters. The Water Quality Certification is based on an environmental assessment (EA2506221-001) of the physical and chemical quality of the material to be dredged and the finding of low risk to the protected uses of the Pennsylvania waters of Lake Erie. The Water Quality Certification is contingent upon compliance with the Erosion and Sediment Control Plan submitted for the project and places constraints on the dates when dredging activities may take place.

The Following Plans and Reports Were Submitted Under the Storage Tank and Spill Prevention Act (35 P.S. §§ 6021.101—6021.2104).

 Provisions of 25 Pa. Code Chapter 245, Subchapter D, Administration of the Storage Tank and Spill Prevention Program, require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A remedial action plan is submitted to summarize the site characterization, document the design and construction details for the remedial action, and describe how the remedial action will attain the selected remediation standard. The remedial action plan also provides results of studies performed and data collected to support the remedial action and a description of postremediation care requirements. A remedial action completion report is submitted to document cleanup of a release of a regulated substance at a site to the selected remediation standard. A remedial action completion report provides a description of the site investigation to characterize the nature and extent of contami-nants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

 This request, received April 7, 2021, is entitled Major Amendment, HDD S3-0290 Installation Method Change and Additional Temporary Workspace, Upper Uwchlan Township, Chester County. This amendment consists of a change in the route and installation method for the 20-inch diameter pipeline previously permitted as Horizontal Directional Drill (HDD) 290.

 This amendment is being requested for a change in the horizontal directional drill (HDD) installation method for the 20-inch diameter pipeline to a conventional open trench construction. The new installation plan will involve use of the open cut construction method across Wetland H17 and dry open cut construction methods across Streams S-H10 and S-H11, and open cut construction under the intersection of Milford Road and Little Conestoga Road and under Highview Road. Additional temporary workspace will be required.

 An increase to the limits of disturbance of 5.42 acres is being requested.

PA Pipeline Project (PPP)/Mariner East II; Permit Amendment Virtual Public Hearing.

 In accordance with current COVID-19 mitigation efforts, the Pennsylvania Department of Environmental Protection (DEP) will hold a Virtual Public Hearing to receive comments from citizens and interested stakeholders on Chapter 102, Erosion and Sediment Control Permit ESG0100015001 and Chapter 105, Water Obstruction and Encroachment Permit E15-862 Amendment requests currently under technical review for PA Pipeline Project (PPP)/Mariner East II Project, HDD 290.
