Availability of Technical Guidance

 Technical guidance documents (TGD) are available on the Department of Environmental Protection's (Department) web site at The ''Technical Guidance Final Documents'' heading is the link to a menu of the various Department bureaus where each bureau's final TGDs are posted. The ''Technical Guidance Draft Documents'' heading is the link to the Department's draft TGDs.

Ordering Paper Copies of Department Technical Guidance

 The Department encourages the use of the Internet to view and download TGDs. When this option is not available, persons can order a paper copy of any of the Department's draft or final TGDs by contacting the Department at (717) 783-8727.

 In addition, bound copies of some of the Department's documents are available as Department publications. Check with the appropriate bureau for more information about the availability of a particular document as a publication.

Changes to TGDs

 Following is the current list of recent changes. Persons who have questions or comments about a particular document should contact the person whose name and phone number are listed with each document.

Final TGD: Minor Revision

DEP ID: 563-2112-656. Title: Liners—Impoundments, Stockpiles, and Coal Refuse Disposal Areas. Description: This minor revision will change the name of this policy from Liners—Impoundments, Stockpiles, and Coal Refuse Disposal Areas, to Liners and Caps for Coal Refuse Disposal Areas.

 This guidance document is used in the design of groundwater and surface water protection systems for coal refuse disposal areas and coal processing areas to prevent groundwater contamination. The TGD applies to impoundments and storage areas at coal refuse disposal or coal processing sites, or both, used for the storage or treatment of mine drainage, runoff contaminated by metals or sulfate, leachate from coal refuse disposal areas and water from coal processing operations.

 Coal refuse disposal areas are regulated under 25 Pa. Code Chapters 88 and 90 (relating to anthracite coal; and coal refuse disposal), which is currently undergoing a proposed rulemaking in response to statutory changes. Concurrently, the Department will revise this TGD to incorporate caps used at coal refuse disposal sites in the future. A title change is part of that revision. Because the title of this document appears in the existing 25 Pa. Code Chapter 90, the Department is changing the title in this minor revision to allow the corrected title to be applied within the 25 Pa. Code Chapter 90 proposed rulemaking.

Written Comments: This revision reflects a minor administrative change with no substantive changes. Because this is a minor revision, no public comment period is warranted.

Draft TGD: New Guidance

DEP ID: 563-2112-613. Title: Implementation of Remining Regulations. Description:  This guidance reflects the current Subchapter F/G regulations that were published October 22, 2016. The purpose of this guidance is to identify and explain conditions that must be met to qualify for and obtain a Subchapter F/G permit authorization (remining of areas of pre-existing pollutional discharges) and the obligations of a mine operator under that permit. This guidance will also address procedures to be followed to modify these permit types and the standards to be met to qualify for bond release.
