THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

FINAL ACTIONS TAKEN FOR NPDES PERMITS AND WQM PERMITS

 The Department has taken the following actions on previously received applications for new, amended, and renewed NPDES and WQM permits, applications for permit waivers, and NOIs for coverage under General Permits, as listed in the following tables. This notice of final action is published in accordance with 25 Pa. Code Chapters 91, 92a, and 102 and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376). The official file for each listed action can be reviewed at the DEP or delegated county conservation district (CCD) office identified in the table for the action. DEP/CCD office contact information is listed as follows for Section I and is contained within the table for Section II.  Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P.S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Hamilton Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30-days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

 For individuals who wish to challenge an action, the appeal must reach the Board within 30-days. A lawyer is not needed to file an appeal with the Board.

Plan Description:

 The exemption from the requirement to revise the Official Plan for the Lark Meadows Residential Subdivision, DEP Code No. A3-21912-266-3E, APS Id 1052815, is disapproved. The proposed subdivision consists of the creation of fifteen new lots, of which fourteen are for new single-family dwellings and one for stormwater management. A residual lot containing an existing dwelling and the fourteen lots proposed for new dwellings are to utilize a new force main with proposed flows of 2,850 gallons per day (gpd) to be collected, conveyed, and treated by Lower Allen Township. The proposed subdivision is located off of Manor Drive in Lower Allen Township. This plan is disapproved because it does not qualify as an exemption from the requirement to revise the Official Plan. It does not qualify because the subdivision proposes the connection to or an extension of public sewer facilities which require or which must apply for a new or modified permit from DEP under the Pennsylvania Clean Streams Law (CSL) as per Chapter 71, Section 71.51(b)(5).

LAND RECYCLING AND
ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995
PREAMBLE 2


The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.908).

 Provisions of Sections 301—308 of the Land Recycl- ing and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

 For further information concerning plans or reports, contact the environmental cleanup program manager in the Department Regional Office under which the notice of receipt of plans or reports appears. If information concerning plans or reports is required in an alternative form, contact the community relations coordinator at the appropriate Regional Office. Resource Environmental Management, 50 Maple Street, Montrose, PA 18801, on behalf of Callon (Marcellus) LLC, 200 West Sam Houston Parkway South, Suite 2000, Houston, TX, submitted a Final Report concerning remediation of soil and groundwater contaminated by a release of brine. The report is intended to document remediation of the site to meet a combination of Background and Statewide health standards.

LAND RECYCLING AND

 Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

If information concerning a final report is required in an alternative form, contact the community relations coordinator at the appropriate Regional Office. The Final Report demonstrated attainment of Statewide health standards and was approved by DEP on December 10, 2021.

Former Leiser's Property, 3608 Nazareth Pike, Bethlehem, PA 18020, Bethlehem Township, Northampton County. MEA, Inc., 1365 Ackermanville Road, Bangor, PA 18013, on behalf of Collaboration 3A, LLC, One East Broad Street, Suite 310, Bethlehem, PA 18018, submitted a Final Report concerning remediation of soil and groundwater contaminated by a release of gasoline from an underground storage tank. The Final Report demonstrated attainment of Statewide health standards and was approved by DEP on December 8, 2021.

WR 22 Five E's Well Pad, 1203 Williams Road, Friendsville, PA 18818, Middletown Township, Susque- hanna County. Folsom Engineering, 117 Roger Hollow Road, Mehoopany, PA 18629, on behalf of SWN Production Company LLC, 917 State Route 92 North, Tunkhannock, PA 18657, submitted a Final Report concerning remediation of soil contaminated by drill cuttings from natural gas wells. The Final Report demonstrated attainment of a combination of Background and Statewide health standards and was approved by DEP on December 9, 2021.

Caron Treatment Center, 229 North Galen Hall Road, Wernersville, PA 19565, South Heidelberg Township, Berks County. Environmental Solutions, 61 Willow Street, Adamstown, PA 19501, on behalf of Caron Treatment Center, P.O. Box A, Wernersville, PA 19565, submitted a Final Report concerning remediation of site soil contaminated with lead and arsenic. The Final Report did not demonstrate attainment of the residential Statewide health standard and was disapproved by the Department on December 7, 2021.

Subject to an elective restriction of 495,000-TPY asphalt production restriction to limit CO emissions below the 100-TPY major source threshold, the facility is Synthetic Minor for permitting purposes. In this renewal, a 350-hp diesel engine, which powers an existing portable RAP crushing plant onsite, is added as a permitted source. A 449-hp diesel engine, which was replaced by the 350-hp diesel engine, is removed from the permit. Requirements based on RFDs approved and conditional exemptions pursuant to 25 Pa. Code § 127.14(a)(8) are removed because they are not enforceable as permit conditions.

42-00133: Collins Pine Company/Kane Hardwood Division (95 Hardwood Drive, Kane, PA 16735-3011). On December 7, 2021, the Department issued the renewal State Only Natural Minor Operating Permit for the sawmill and kiln operations located in Wetmore Township, McKean County. The facility's primary emission sources include the 38 mmBtu/hr wood-fired boiler controlled by a cyclone, sawmill operations, ten (10) lumber-drying kilns, a cold solvent degreaser, a dimension plant, and shipping operations. The potential emissions of the primary pollutants from the facility are as follows: 81.56 TPY (tons per year) NOx, 99.86 TPY CO, 3.16 TPY VOC, 46.88 TPY filterable PM-10 and PM-2.5, and 4.16 TPY SOx; thus, the facility is a natural minor. The wood boiler is subject to 40 CFR 63 Subpart JJJJJJ, NESHAP for Industrial, Commercial, and Institutional Boilers Area Sources. The renewal permit contains emission restrictions, recordkeeping, work practices, and additional requirements to ensure compliance with the Clean Air Act and the Air Pollution Control Act.

The Department of Environmental Protection (Department) issued a Plan Approval to General Machine on February 4, 2021 for a paint booth. The Department inspected the facility on September 28, 2021. The actual amount of coatings and solvents used in the paint booth are of a minimal amount which is approximately 0.01 ton/year of actual VOC emissions. The Plan Approval was re- voked as the VOC emissions were minimal and it meets the current exemption listed in 25 Pa. Code § 127.14(a)(8)(31), ''Sources of uncontrolled VOC emissions from a project that are less than 2.7 tons on a 12-month rolling basis''. Therefore, the paint booth is exempt from Plan Approval requirements.
