48-00003H: Keystone Cement Company, Route 329, Bath, PA 18014-0058, East Allen Township, Northampton County. The Department of Environmental Protection (Department) is denying Keystone Cement Company's (Keystone's) plan approval application 48-00003H pursuant to 25 Pa. Code § 127.13b(a)(1) and (2). The air quality plan approval was received in March 2022 for replacement of two 17,500-gallon capacity and two 35,000-gallon capacity liquid waste fuel storage tanks with six new 32,000-gallon capacity and one new 28,000-gallon capacity liquid waste fuel above ground storage tank. The control device configuration proposal includes three carbon canister units to control VOC from all six tanks, and an identical duplicate control configuration for the railcar unloading AST. The two 1,800 lb units are operated in parallel, and emissions from the two parallel units are then vented to a third 1,800 lb polishing unit. After reviewing the applicant's responses to the Department's July 26, 2022 and August 31, 2022 technical deficiency letters with regard to the previously referenced application, the Department determined that the application continues to be technically deficient. The deficiencies identified in the Department's technical deficiency letters were based on applicable laws and regulations. After reviewing and considering Keystone's responses to those deficiency letters, the Department has determined that Keystone's responses failed to adequately address the following deficiency: Keystone's BAT analysis must reference and satisfactorily address previous RACT and BAT determinations for the storage tanks. The proposed breakthrough emission limit must be at least as stringent as the EPA-Approved Source-Specific Reasonably Available Control Technology (RACT) Requirements for Keystone Cement Company's existing storage tank carbon adsorbers, which has a breakthrough VOC concentration of 20 ppmv, as approved by EPA on June 3, 1997 and which is codified at 40 CFR 52.2020(d)(1) (related to EPA—Approved Source-Specific RACT Requirements for VOCs and NOx). This deficiency was identified in the Department's July 26, 2022 and August 31, 2022 Technical Deficiency Letters. Provisions of 25 Pa. Code Chapter 245, Subchapter D, Administration of the Storage Tank and Spill Prevention Program, require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports.
A remedial action plan is submitted to summarize the site characterization, document the design and construction details for the remedial action, and describe how the remedial action will attain the selected remediation standard. The remedial action plan also provides results of studies performed and data collected to support the remedial action and a description of postremediation care requirements. A remedial action completion report is submitted to document cleanup of a release of a regulated substance at a site to the selected remediation standard.
