 Formal complaints have been issued by the Pennsylvania Public Utility Commission. Answers must be filed in accordance with 52 Pa. Code (relating to public utilities). Answers are due June 12, 2023, and must be made with the Secretary, Pennsylvania Public Utility Commission, 400 North Street, Harrisburg, PA 17120, with a copy to the First Deputy Chief Prosecutor, Pennsylvania Public Utility Commission.

COMPLAINT

 The Pennsylvania Public Utility Commission (Commission) is a duly constituted agency of the Commonwealth of Pennsylvania empowered to regulate public utilities within the Commonwealth. The Commission has delegated its authority to initiate proceedings which are prosecutory in nature to the Bureau of Investigation and Enforcement and other bureaus with enforcement responsibilities. Pursuant to that delegated authority and Section 701 of the Public Utility Code, the Bureau of Investigation and Enforcement hereby represents as follows:

 1. That Big Man 1 Transport, LLC Respondent, maintains a principal place of business at 281 Governors Park Rd., Bellefonte, PA, and a mailing address at 1319 N. May Avenue 204, Oklahoma City, OK 73134.

 2. On, October 5, 2022, by Commission Secretarial letter, Respondent was issued a certificate of public convenience by this Commission authorizing transportation, as a common carrier, by motor vehicle, property, excluding household goods in use, between points in Pennsylvania at PUC utility code no. 8925674. Respondent was further advised ''Certificate holder is advised to become familiar with the requirements of 52 Pa. Code. Failure to comply with all applicable requirements may subject the carrier to penalties, including fines suspension of operating rights or cancellation of authority. Title 52 of the Pennsylvania Code may be accessed on the World Wide Web at www.pacode.com.''

 3. PUC Enforcement Supervisor Ernest Snyder attempted several times to contact Respondent. On March 13, 2023, a certified and a first-class letter was sent to the carrier with a request contact.

 4. On January 9, 2023, Officer Stover texted a message to the carrier requesting the carrier send an email so that he may email the information on the requirements required to earn a successful Safety Fitness Review. As of March 17, 2023, no attempt to contact Officer Stover has been made by the carrier by phone, text, or email.

 5. On March 13, 2023, the Pittsburgh Regional Office sent a letter regular mail and certified to the Respondent to an Oklahoma address listed for the company and on April 5, 2023, another first class and certified letter was sent to the Respondent to the Pennsylvania address for the Respondent, which was returned to the Pittsburgh Regional office as unclaimed.

 6. That Respondent, by failing to achieve a satisfactory evaluation on a safety fitness review, violated 66 Pa. Code § 501(c) and, for failure to maintain adequate, efficient, and safe service and facilities, violated 66 Pa. Code § 1501. The penalty for this violation is cancellation of the certificate held by Respondent with this Commission at utility code 8925554.

Wherefore, the Bureau of Investigation and Enforcement hereby requests that the Commission revoke the certificate of public convenience issued Big Man 1 Transport LLC, at PUC utility code no. 8925674.

COMPLAINT

 The Pennsylvania Public Utility Commission (Commission) is a duly constituted agency of the Commonwealth of Pennsylvania empowered to regulate public utilities within the Commonwealth. The Commission has delegated its authority to initiate proceedings which are prosecutory in nature to the Bureau of Investigation and Enforcement and other bureaus with enforcement responsibilities. Pursuant to that delegated authority and Section 701 of the Public Utility Code, the Bureau of Investigation and Enforcement hereby represents as follows:

 1. That Rezk Trucking, LLC, Respondent, maintains a principal place of business at 4012 Crawford Avenue, Northern Cambria, PA 15714.

 2. On, October 5, 2022, by Commission Secretarial letter, Respondent was issued a certificate of public convenience by this Commission authorizing transportation of property for compensation at PUC utility code no. 8925554. Respondent was further advised ''Certificate holder is advised to become familiar with the requirements of 52 Pa. Code. Failure to comply with all applicable requirements may subject the carrier to penalties, including fines suspension of operating rights or cancellation of authority. Title 52 of the Pennsylvania Code may be accessed on the World Wide Web at www.pacode.com.''

 3. On December 1, 2022, PUC Enforcement Officer Gerald Stover called the phone number for the company and left a voicemail for the carrier to contact the officer regarding the Safety Fitness Review. Officer Stover attempted several times to contact Respondent by phone. On December 28, 2022, a certified and a first-class letter was sent to the carrier with a request contact.

 4. On January 9, 2023 Officer Stover texted a message to the carrier requesting the carrier send an email so that he may email the information on the requirements required to earn a successful Safety Fitness Review. As of March 17, 2023, no attempt to contact Officer Stover has been made by the carrier by phone, text or email.

 5. That Respondent, by failing to achieve a satisfactory evaluation on a safety fitness review, violated 66 Pa. Code § 501(c) and, for failure to maintain adequate, efficient, and safe service and facilities, violated 66 Pa. Code § 1501. The penalty for this violation is cancellation of the certificate held by Respondent with this Commission at utility code 8925554.

Wherefore, the Bureau of Investigation and Enforcement hereby requests that the Commission revoke the certificate of public convenience issued Rezk Trucking, LLC, at PUC utility code no. 8925554.

COMPLAINT

 The Pennsylvania Public Utility Commission (Commission) is a duly constituted agency of the Commonwealth of Pennsylvania empowered to regulate public utilities within the Commonwealth. The Commission has delegated its authority to initiate proceedings which are prosecutory in nature to the Bureau of Investigation and Enforcement and other bureaus with enforcement responsibilities. Pursuant to that delegated authority and Section 701 of the Public Utility Code, the Bureau of Investigation and Enforcement hereby represents as follows:

 1. That JNF Express, Inc., Respondent, maintains a principal place of business at 831 Woodlawn Street, Scranton, PA 18509.

 2. On, November 3, 2021, by Commission Secretarial letter, Respondent was issued a certificate of public convenience by this Commission authorizing transportation, as a common carrier, by motor vehicle, property, excluding household goods in use, between points in Pennsylvania.at PUC utility code no. 8924599. Respondent was further advised ''Certificate holder is advised to become familiar with the requirements of 52 Pa. Code. Failure to comply with all applicable requirements may subject the carrier to penalties, including fines suspension of operating rights or cancellation of authority. Title 52 of the Pennsylvania Code may be accessed on the World Wide Web at www.pacode.com.''

 3. PUC Enforcement Officer Barry Pacovsky attempted several times to contact Respondent. On March 1, 2023, a first-class letter was sent to the carrier with a request contact and on March 6, 2023, a certified letter was sent. The certified letter was unclaimed and returned to the Scranton Regional Office on April 5, 2023.

 4. That Respondent, by failing to achieve a satisfactory evaluation on a safety fitness review, violated 66 Pa. Code § 501(c) and, for failure to maintain adequate, efficient, and safe service and facilities, violated 66 Pa. Code § 1501. The penalty for this violation is cancellation of the certificate held by Respondent with this Commission at utility code 8924599.

Wherefore, the Bureau of Investigation and Enforcement hereby requests that the Commission revoke the certificate of public convenience issued JNF Express Inc, at PUC utility code no. 8924599.

 The Pennsylvania Public Utility Commission (Commission) is a duly constituted agency of the Commonwealth of Pennsylvania empowered to regulate public utilities within the Commonwealth. The Commission has delegated its authority to initiate proceedings which are prosecutory in nature to the Bureau of Investigation and Enforcement and other bureaus with enforcement responsibilities. Pursuant to that delegated authority and Section 701 of the Public Utility Code, the Bureau of Investigation and Enforcement hereby represents as follows:

 1. That McMurdy Trucking & Excavating, LLC, Respondent, maintains a principal place of business at 256 Byers Road West, Sunbury, PA 16061.

 2. On, April 22, 2022, by Commission Secretarial letter, Respondent was issued a certificate of public convenience by this Commission authorizing transportation, as a common carrier, by motor vehicle, property, excluding household goods in use, between points in Pennsylvania at PUC utility code no. 00119077. Respondent was further advised ''Certificate holder is advised to become familiar with the requirements of 52 Pa. Code. Failure to comply with all applicable requirements may subject the carrier to penalties, including fines, suspension of operating rights or cancellation of authority. Title 52 of the Pennsylvania Code may be accessed on the World Wide Web at www.pacode.com.''

 3. On April 27, 2022, PUC Enforcement Officer Gerald Stover contacted the Respondent via email at Kmcmurdy@hotmail.com at which time the carrier chose to email the required documents when available, to pass the review. Several attempts were made by phone and email and as of March 17, 2023, no documents were provided and no contact by phone or email has been successful.

 4. On March 29, 2023, a first class and a certified letter was mailed to the Respondent, which was delivered April 5, 2023. No response has been received.

 5. That Respondent, by failing to achieve a satisfactory evaluation on a safety fitness review, violated 66 Pa. Code § 501(c) and, for failure to maintain adequate, efficient, and safe service and facilities, violated 66 Pa. Code § 1501. The penalty for this violation is cancellation of the certificate held by Respondent with this Commission at utility code 00119077.

Wherefore, the Bureau of Investigation and Enforcement hereby requests that the Commission revoke the certificate of public convenience issued McMurdy Trucking & Excavating, LLC, at PUC utility code no. 00119077.
