FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department of Environmental Protection (DEP) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval, and requests for Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, DEP has granted 401 Water Quality Certification certifying that the construction and operation described will comply with the applicable provisions of Sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317), and that the construction will not violate applicable Federal and State Water Quality Standards.

 To remove the existing stream enclosure about 1,354 feet of 72-inch RCP and relocate/construct and maintain new about 1,286 LF of 72-inch x 96-inch RC box stream enclosure along a UNT to Matsunk Creek (WWF-MF) associated with the construction of two new warehouse/distribution centers. Additionally, this project involves the connection of the onsite stormwater management system to the existing piped UNT to Schuylkill River (WWF, MF). The project will include the loading docks, parking area, utilities, landscaping, and stormwater management necessary to support the project. Old existing structures within the area will be demolished and removed. The site is located at 800 River Road (Norristown, PA USGS Quadrangles) in Upper Merion Township, Montgomery County.  To restore and rehabilitate about 450 feet of an unnamed tributary to Mill Creek (WWF) associated with the applicant's request for 105.12(a)(16) waiver to conduct stream restoration and enhancement. The proposed rehabilitation will include: 1) Floodplain reconnection through the removal of legacy sediments. 2) Pockets of wetlands will be installed which will help offset the effects of the toe-protection along the streambanks. 3) Installation of a 3-tier riparian forest buffer. 4) Streambank Reinforcement: all streambanks within the project area will be regraded to a slope of 3:1 (horizontal: vertical). Geotextile and vegetation will be used to reinforce and stabilize the banks. 5) The toe-protection consists of 12-to-18-inch diameter, native stones placed below bank-full height. 6) The southern most meander shows a cut-bank of close to 8 feet in height. At this location, additional protection, vegetated soil lifts will be installed above the bank-full height to the 100-year storm elevation. No excavation within the stream channel is proposed and no wetlands were identified within the project area. Mill Creek does not have special protection status. Given that the limit of disturbance associated with the project is less than one acre, the project does not require an individual NPDES Permit for Discharges of Stormwater Associated with Construction Activities. The project is located west of the intersection of Old Anchor Road and Second Street Pike (Lambertville, PA USGS Quadrangle) in Wrightstown Township, Bucks County. The project will permanently affect 0.065 acre of the floodway to Indian Creek. The water intake will permanently impact 1 LF of Indian Creek, and the overflow pipe will permanently impact 1 LF of Indian Creek.  The project included installation of 9 log vane, structures, 270-feet of mudsill cribbing, stabilization and channel blocks to restore the stream alignment to historic location and dimension and stabilize channel. The Major Amendment proposes the addition of 650 linear feet of restoration activities within and along a receiving tributary, McDonald Run, that includes the installation and maintenance of seven log vanes, resulting in 285 linear feet of permanent impact, the installation and maintenance of mudsill cribbing, resulting in 40 linear feet of permanent impact, the excavation and maintenance within the stream channel to remove an existing gravel bar, resulting in 70 linear feet of permanent impact to McDonald Run (WWF, MF), and the installation and maintenance of riparian plantings. The project is located near 120 Standish Lane, approximately 0.4-mile East of intersection with Dunnings Highway.  In accordance with 25 Pa. Code §§ 129.96—129.100, the Pennsylvania Department of Environmental Protection has made a preliminary determination to approve a RACT 2 plan and an amendment to the State Implementation Plan (SIP) for the Keystone Station owned and operated by Keystone-Conemaugh Projects, LLC in Plumcreek Township, Armstrong County.

 The proposed SIP revision does not adopt any new regulations. It incorporates the provisions and requirements contained in the 40 CFR 52.2065 as RACT 2 for the facility, which are intended to satisfy the requirements for the 1997 National Ambient Air Quality Standard (NAAQS) and the 2008 NAAQS for ozone.

 The proposed amendments to the RACT 2 determinations, if approved, will be incorporated into a revised operating permit (03-00027) for the facility. The relevant RACT 2 requirements will be submitted to the U.S. Environmental Protection Agency (EPA) as a revision to Pennsylvania's State Implementation Plan and will remain in effect until replaced pursuant to 40 CFR 51 and approval by the EPA. Requirements that are not part of the RACT 2 determinations will be excluded from the SIP submittal.

 The following is a summary of the proposed amendments to the RACT 2 determination for this operation that will be submitted to the EPA as a SIP revision:

 • The total combined NOx emissions from Boilers 1 and 2 shall not exceed 0.075 lb/MMBtu on a 30-operating day rolling average.

 • Daily NOx emissions from Boiler 1 shall not exceed 15,691 lb per unit operating day.

 • Daily NOx emissions from Boiler 2 shall not exceed 15,691 lb per unit operating day.

 • The permittee shall utilize the following methods when determining compliance with the NOx RACT emission limits: (a) For 30-operating day rolling average NOx emission limit, 40 CFR parts 60 and 75, appendix F, Procedure 1; (b) For the Unit-specific Daily NOx Mass Emission Limits, 40 CFR part 75; and (c) All monitoring and testing shall be conducted in accordance with 25 Pa. Code Chapter 139, Subchapter C.

 • The permittee shall: (a) Operate the SCR systems associated with Boiler 1 and/or 2 at all times the source is in operation and it is technically feasible to do so in accordance with manufacturer specifications for the SCR systems and sound engineering principles. This requirement applies regardless of the fuel type being combusted in the boiler. (b) Utilize reagent in the SCR systems at a rate that is optimized to maximize the degree of NOx control while minimizing ammonia slip, and (c) Operate and maintain the SCR systems in accordance with manufacturer specifications and good operating practices for the control of the NOx emissions.

 • The permittee shall create and maintain records of: (a) the hourly heat input for each unit; (b) The specific hourly ammonia injection amounts for each unit; and (c) The specific hourly NOx emission rate for each unit. Records shall be retained for at least five years.

 • The permittee shall electronically submit a periodic report, within thirty days after the end of each six-month reporting period. The periodic report shall contain data for each Operating Day during the reporting period, including, but not limited to: Facility ID; Facility name; Unit ID; Date; Unit-specific total Daily Operating Time; Unit-specific Daily NOx Mass Emissions; Unit-specific total Daily Heat Input; Unit-specific Daily NOx Emission Rate; Facility-wide 30-Day Rolling Average NOx Emission Rate; Owner; Operator; and Representative (Primary and Secondary). The periodic report shall be certified by the Responsible Official for the facility.

 • Boilers 1 and 2 are also subject to a Federal Implementation Plan for NOx RACT 2, which is codified in 40 CFR 52.2065.

 In addition, 40 CFR 51.308(f)(2) of the Regional Haze Rule requires State Implementation Plans to include enforceable emissions limitations, compliance schedules, and other measures that are necessary to make reasonable progress as determined pursuant to 40 CFR 51.308(f)(2)(i)—(iv). To satisfy four-factor analysis requirements related to the second implementation period for Regional Haze, the Department proposes to add a requirement to make the previously identified shutdown date on or before December 31, 2028 for Source 031 and Source 032 (Boiler 1 and 2) Federally enforceable and permanent.

Public hearing. A public hearing will be held if requested by February 21, 2024 to accept oral comments on the proposed operating permit revision and the proposed SIP revision.
