§ 35.127. Limiting number of witnesses.
The agency head or the presiding officer may limit appropriately the number of witnesses who may be heard upon an issue.
Notes of Decisions The hearing examiner having the authority to limit the number of witnesses did not violate the insurance agent’s rights of due process by precluding the testimony of a witness since the examiner determined such irrelevant. Park v. Chronister, 617 A.2d 863 (Pa. Cmwlth. 1992); appeal denied 627 A.2d 231 (Pa. 1993).
