§ 12.1. Purpose.
The Department is responsible for the conduct of examinations of insurers and other entities subject to its administrative or regulatory authority under Article IX of the act (40 P. S. § § 323.1323.8). Examinations are conducted to verify the financial condition of the examinee and ascertain whether the examinee has complied with the laws of the Commonwealth. Section 907 of the act (40 P. S. § 323.7) provides that the expenses incurred in and about the examination of an entity, including compensation of Department employees assisting in an examination and other professionals or specialists retained as examiners, shall be charged to and paid by the examinee. This chapter specifies the types of examination costs charged to examinees and the manner in which amounts charged are determined.
