§ 4310.22. Appeals.

 The fair hearing will be conducted by the Department’s Office of Hearings and Appeals in conformance with the Department’s Office of Hearings and Appeals’ procedures. The institutional collections officer completing the liability assessment shall participate in the hearing to explain how the assessment was completed. The Department staff member responsible for reviewing the request for abatement or modification or both shall participate in the hearing process.

Notes of Decisions

   This section does not provide specific time restraints for final administrative action by the Department in reviewing a request for an abatement or modification of an assessed liability. Mulgrew v. Department of Public Welfare, 557 A.2d 1160 (Pa. Cmwlth. 1989); appeal denied 574 A.2d 74 (Pa. 1990).
